I wasn't a JAG officer if that's what you're getting at. And I've never served on a court martial. But that doesn't mean that I'm not familiar with the process.

I read it. I still have the same question. Why didn’t he come forward (publicly) before now? Following the chain of command and adhering to procedure doesn’t prevent a leak to the press about one’s suspicions. Why now?

Well in the UK Military it has been known for a military unit in barracks to passively refuse orders.
The C/O of the unit concerned was transfered, non of the soldiers concerned was punished.
That won’t work on a ship, but it is possible on land.
How long before SecDef. Gates resigns if these court martials spread?
My reading of the man is that he stayed on to try to protect the country from harm. There is a limit though.
Well I certainly don't wish him in Leavenworth and I don't see that as a possibility. And he certainly doesn't deserve to be demonized in any way. He's made his decision and I respect him for it. But I also think that he's throwing he career away and nothing will come of it.
I ask again sir, who then has standing?

Even if Obama is not legally President, that doesn’t necessarily defeat the legal authority of commissioned officers. Even if Barack Hussein Obama’s entire Presidency is declared void, that just means Joseph Robinette Biden has been acting President since 20 January, 2009, pursuant to Section 3 of the 20th Amendment, and that commissioned officers are his agents.

First, what is a legal order?
It seems a legal order must:
1. be made by an appropriate military superior/authority
2. relate to military duty (i.e. must have something to do with the current operation)
3. not contravene the Constitution or any existing laws (and treaties)
Second, do you see anything here the Lt. Col could base his defense on?

That’s true; however, all signatures, orders and guidance have not been coming from Biden as CinC...they’ve been signed by Obama. That doesn’t mean that commissioned officers don’t have authority, but merely that they’ve been acting under orders of questionable legitimacy...that’s the issue in question, and the matter on which this LTC is seeking clarification...which is his duty.
