The Constitution does not specify that a Bible must be used. The use of the Bible is traditional only, not a legal requirement. Only the precise words to be said in the oath are indicated in the Constitution.

End result, the Cherokees got screwed (and pretty much all the other tribes as well). It’s funny that had that ruling been enforced, the White governments wouldn’t have had the right to displace any existing Native government, let alone having political authority to dictate to them. It would’ve been a nightmare for settlers all over if they weren’t able to purchase the land from the tribes themselves, as they would’ve been hemmed into the lands already held. I could see Jackson’s point of view and that this could end up a nightmare of bloodshed, but it’s hard to look at it all without coming to the conclusion that the President of the United States by his response essentially declared it was A-OK to run roughshod over Native Americans leading to their removal from their lands.

Can anyone name those presidents that refused to take the oath with their hand on the bible?

John Quincy Adams (swore on a law book), Teddy Roosevelt (no book at all), Franklin Pierce ("affirmed," didn't swear, no book).

In 1929, Chief Justice William Howard Taft garbled the oath when he swore in President Herbert Hoover using the words "preserve, maintain, and defend the Constitution", instead of "preserve, protect, and defend". Taft eventually acknowledged his error, but did not think it was important, and Hoover did not retake the oath. Source

It has also happened that presidents took the oath twice, either because they took it in private on the death of their predecessor and wanted the oath to be recorded publicly, or because Inauguration Day fell on a Sunday and the public festivities were scheduled for the following Monday.

Now wait a minute. By what authority you swear has moral and social implications. I was just saying that if you swear without swearing by anything, you are saying in effect, “because I said so.”

And that is evil.

Maybe if they screw this up a few more times, somebody within the District of Columbia will be prompted to actually pick up and read the damn Constitution.

Aren’t they the ones who said Rice was acting president for one minute between noon and the time Biden was sworn in? I guess they never heard of the Speaker of the House and the President Pro Temp of the Senate.

Hate to burst the bubble, but as someone who has raised his right hand and been sworn into office as a commissioned officer in the U.S. Army, the verbal oath is simply ceremonial. The real oath occurs with one’s signature on a piece of paper.

Irrelevant. IT’s not like Obama screwed up the first oath on purpose....if it wasn’t for Roberts getting distracted by having to repeat lines for the jumpy Obama, it would of been successful.

Can't buy that theory. Roberts had already made buddies with O by inviting him into the SCOTUS inner sanctum. Clearly Roberts and the rest of the SCOTUS violated basic canons of judicial ethics by fraternizing with an individual who was a party - or important principal - in several pending cases before the SCOTUS at the time of the get-together.
