McCain Should Use Supreme Court to Sway Wary Conservatives

There are four justices over seventy years of age: Stevens 88, Ginsberg 75, Scalia 72, and Kennedy 71. Of these, only Scalia is conservative. With McCain, the GOP can own the Court for decades with conservative replacements. But will he campaign on this issue?

This could lead to rulings such as the overturning of Roe v. Wade, a reversal of the Kelo decision, The court finding there is no constitiutional right to marry (gay marriage), along with a host of other important issues.

Does the author really believe McCain wants this?

Conservatives should not have to be told about the Court. It should be ingrained into their very being.

With McCain, we are likely to get moderate-liberals like Anthony Kennedy. If he gets to replace Ginsburg or Stevens (the most likely to step down in the next 4 years) it will be a slight improvement.

With Obama, we are certain to get far left wing liberals. (How does Justice Chuck Schumer sound?) If Obama replaces Ginsburg or Stevens it means solidifying the far left wing branch of the Court for another generation.

What keeps me up at night is the possibility of either getting to replace Scalia. Scalia is reportedly in good health, but he is 72 and has been on the Court for over 20 years.

There are also the dozens of appellate and district court judges that the next President will get to replace. Since hardly any cases make it all the way to the Supreme Court, the appellate and district courts have a much greater affect on most of our day to day lives.

I wish we had a Republican candidate that we could count on to nominate conservative judges. We don't. We do have a Democrat candidate that we can count on to nominate far left wing judges. Given that either McCain or Obama is going to be our next President, I'm voting for McCain and hoping that he does not do too much damage.

McCain has proven to be untrustworthy - on judges especially.

Unless Republicans win the Senate, McCain could burn with desire to seat 4 clones of Antonin Scalia, and it won’t make a bit of difference.

He won’t seat any one of the four.

Owning the Senate and the Presidency made all the difference with Roberts and Alito.

The flaw in that ointment is that 3 of those 4 were appointed by Republican presidents.

McMaverick-reaching-across-the-aisle, who would face a Dem controlled Senate Judiciary Committee and Dem controlled Senate, would hardly rock the boat and try to appoint conservatives.

First, he has significant disdane for conservatives anyway.

Second, he would have to make appointments he could get through the Senate -- controlled by Dems who are not going to allow him to move the SC any more to the right.

Oh' the fly in the ointment.

The ONLY comfort is McCain will nominate moderate middle of the road justices, that will turn socialist in about 10 years as compared to Obama appointing outright Marxist from the get go

McCain should frequently mention the situation with future judge vacancies, and he should truly also be attacking the possible full enactment of the Fairness Doctrine often in order to silence conservatism for the long-term throughout the U.S. among a bunch of other issues! A Democratic majority in both Congress and the White House will truly harm the entire country for the long-term on all of the issues, and all conservatives must truly do their best to stop the U.S. from becoming a socialistic country for the long-term!

Probably the biggest reason McCain is the GOP nominee for president in 2008 is because it ensures that a fifth conservative NEVER reaches the Supreme Court - regardless of who is elected in November.
