Discovery hearing set as jurors deliberate for ninth day

A request by the prosecution in the David Westerfield kidnap-murder trial to obtain more evidence or information, originally scheduled for a 10:30 a.m. hearing, has been vacated.

Word of the hearing's cancellation was relayed to media representatives shortly after 10 a.m. today.

The subject of the discovery motion filed by lead prosecutor Jeff Dusek was not disclosed. No reason was given for the hearing's cancellation.

Today is the ninth day of deliberation by jurors. Today's deliberating session began at 9:07 a.m., according to a public information officer.

Westerfield, 50, is accused of the kidnap and murder of 7-year-old Danielle van Dam, who disappeared from her bedroom in her family's Sabre Springs home on Feb. 2.

I think it'll be an aquittal, but I was very shocked to read the LKL thing. I hadn't been following any tv stuff. I had the impression this Grace creature was getting edgy and so on because she feared the jury wouldn't go her way. Oh well. Here's hoping.

I just heard Feldman say to the judge that there is a civil case filed out of state which involves a list witnesses that have a bearing on this case.... Did anyone else hear that?????? I wonder what this could be about?

I feel sorry for DW and the look on his face in the courtroom. He looks like he's in the twilight zone.

I'm here and going fine. They never came close to convincing me of his guilt but did convince 12 good people. Kudos to Kim and the others who did a great job of defending the prosecution case. $25 to FR in Greg's name at next fund raiser and a buck to someone else that I can't remember (was it Kim?)

Many appeals to come. Many books to come that will recover all the researce we've done on these threads. We fought the good fight.

Maybe this explains Mudd's apparent dislike for Feldman.What did he know about this out of state case? Was DW a member of porn ring? Was this the weird connection with Brenda referred to by Feldman in his closing? I know that you can never predict juries but I am really shocked at the verdict.

Glad to hear you are OK. Soon as possible, think I will donate $25 in the name of all the people that were on Prosecution's side and stuck on the threads and fought for it. I will come up with a list of them. VWRC_minion is one. Even though I didn't bet, just because.

If I were on that jury, I would had have to get an answer for 'how did he do it', in order to vote guity that he did it. I guess they, the jury, must have been privey to info that is not publicly known. I agree with you, I'm not convinced either, since reading the testimony.

Hi. I posted my thoughts on the PORN RING info. I believe that he was suspected of being part of it because of the type of PORN being downloaded (by him or Neal). The FBI/SDPD was in process of busting members of this 'ring' and when Danielle went missing, the FBI gave the SDPD a heads up on DW's address.

When SDPD though DW gave suspicious answers, they dogged him. Once DW was a target, all eyes fell on him. All of a sudden, everyone move, every thought, every word of his was suspicious.

The DA needed a perp, DW seemed likely, seemed suspicious, so they went after proof. Maybe they found some, maybe they planted it. Didn't matter to them, they KNEW he was guilty. They knew that he HAD to be another one of these CHILD/PORN/RAPE guys cause they already had busted several of them in the area.

IS DW the unluckiest SOB in the world, as posters have spewed to me on these threads ???????? I would say YES.

Is is possible he really is the BAD GUY, involved in this CHILD PORN ring? YES, it is possible. DO I think so, NO WAY.

I think this will be proven. I hope it comes out soon. Now that DW has been found guilty, I hope TOTAL PROOF comes out that vindicates him. I stick with my knowledge of ALL the details (not just the ones Judge Mudd ALLOWED the jury to hear).

TIME WILL TELL. Let us hope it isn't too much time.

Was this your theory or did you have any other info on which you were relying? Strange in reference to the out of court evidence referred to by Feldman in court today.

This was my theory based on the order of events and the agencies involved. Think about it. The FBI, The FBI dog. The porn ring busts 01/27 and 02/18 in SD and Poway. The Swedish group that is tracking this childporn stuff on the internet.

When LE's searched DW's house, they KNEW TO LOOK for the CHILD PORN. How?
