A curious thing happened in the Supreme Court budget hearing yesterday. Rep. Joe Serrano went on a long monologue about 'diversity' in the court and even said he would be glad when the day came, that a Puerto Rican could be president...to which Thomas replied that the court was avoiding that question. Nervous laughter ensues and the topic is quickly dropped. I'd like to know what my fellow FReepers think of the exchange.
It happens around the 1:13-1:14:10 mark in the video. It would be great if someone could isolate that exchange and put it on YouTube so everyone could hear it without sitting through the entire hearing.

I believe we’ve had presidents or presidential candidates in the past who were born in a territory. Goldwater was born in Arizona Territory. But Arizona became a state. I don’t think there’s been one that was born in a territory that remained a territory.
Even though Obama’s NBC status isn’t a question of territory v. state, it’s hard to imagine another reason for Thomas’s comment about “avoiding.”

I think it means that Thomas is pi$$ed that his hands are tied on the natural born question and would like nothing more than to skewer BO on it.
Oh and btw...a “Puerto Rican” would be fine with me. Most are very conservative and compared to Sontamayer anythings better.

Do listen to it when you get a chance and tell me if I heard it correctly. Cspan doesn’t let you fast forward the video(or else I can’t figure out how to do it). It appeared to me that Thomas’s remark made some folks a tad bit nervous...lol.

It was from a discussion from Rep. Jose Serrano (D-NY) and Thomas about putting Sotomayor on the Supremes. Thomas makes a comment about Puerto Rican immigrants wanting judgeship not having to answer to being born in the US... Serrano says oh really, you haven’t answered if I have to to serve as president and Thomas laughs and says no, “we’re evading that.” Not quotes but the general words. Thomas used the word, “evading”.
Bottom line, it’s a gottcha moment. Thomas admits they don’t want to touch it. Sorry, sorry, thing. Thomas just put himself on my list.
I got the feeling that Thomas was firing a shot across the bow as well. Barbara Lee had been going on and on trying to blame him for the lack of diversity on the court in the 30 minutes prior to the statement. Thomas had tried to explain to her that it wasn’t for the court to decide on the pool of applicants that were submitted to the court for clerkships, etc. and that most members welcomed a diverse pool,etc. Then Serrano gets on his soapbox for several minutes before Thomas shuts them all up with his statement...lol!

‘Evading’ was the word he used...my bad.Thanks for taking the time to listen to it.
I didn’t take it to mean that Thomas is in favor of ‘evading’ the issue, but that the ‘majority’ is...for what-ever reason. Hell...everyone in positions of power in this country is ‘evading’ this question! I don’t blame Thomas. He was speaking the truth and it took courage to even bring it up. He was, after all, speaking to the congressional clowns that hold the purse strings for the court.
