Other than a liberal bent, it couldn’t be any worse than what now inhabits the house.
I believe we’ve had presidents or presidential candidates in the past who were born in a territory. Goldwater was born in Arizona Territory. But Arizona became a state. I don’t think there’s been one that was born in a territory that remained a territory.
Even though Obama’s NBC status isn’t a question of territory v. state, it’s hard to imagine another reason for Thomas’s comment about “avoiding.”

I think it means that Thomas is pi$$ed that his hands are tied on the natural born question and would like nothing more than to skewer BO on it.
Ditto for Scalia and Roberts.
It was from a discussion from Rep. Jose Serrano (D-NY) and Thomas about putting Sotomayor on the Supremes. Thomas makes a comment about Puerto Rican immigrants wanting judgeship not having to answer to being born in the US... Serrano says oh really, you haven’t answered if I have to to serve as president and Thomas laughs and says no, “we’re evading that.” Not quotes but the general words. Thomas used the word, “evading”.
Bottom line, it’s a gottcha moment. Thomas admits they don’t want to touch it. Sorry, sorry, thing. Thomas just put himself on my list.

I wonder if what Justice Thomas said had anything to do with 0bama attempting to spank the Court in public during the State of the Union address.
It happens around the 1:13-1:14:10 mark in the video. It would be great if someone could isolate that exchange and put it on YouTube so everyone could hear it without sitting through the entire hearing.
You don’t have to sit through the entire hearing to listen to the clip part you are referencing. Just take the scroll button and move it to the portion of the hearing you are interested in and then let it play. The reference was first made by the Chairman about 1:05 in the tape and Justice Thomas made a refernce a few moments later in one of his responses.

He KNOWS this is an unresolved question of the Constitution as was "to keep and bear arms" until FINALLY resolved in 2008. In recalling the heat and grief the SCOTUS got from their ruling on Bush v. Gore in 2000, we will unfortunately need another Constitutional Crisis before the SCOTUS is willing to PUSH THROUGH the tall swamp weeds of judicial Political Question.
