During a hearing in U.S. District Court Monday, an attorney for an Army officer fighting deployment to Iraq questioned Barack Obama’s legal right to serve as president, asserting he was born in Kenya, not Hawaii.
Judge Clay Land, inquisitive throughout the 90-minute hearing, said he will issue a decision on Capt. Connie Rhodes’ request for a temporary restraining order by noon Wednesday.
Rhodes was represented by Orly Taitz, a California lawyer and a national figure in the “birther” movement that claims Obama does not meet the qualifications to be president.

Maj. Rebecca Ausprung, with the Department of the Army, Litigation Division in Washington, told Land this case was about Rhodes, not Obama.
“There was a lack of any reference to Capt. Rhodes,” Ausprung said. “This case is about Capt. Rhodes and her deployment.”
Taitz kept going back to Obama’s birth certificate. Twice she called Obama a “usurper.”

Obama has to sign off on ANY deployment orders. Like the new 21,000 troops for Afghanistan, for instance.
Likewise, he has to sign off on any special ops assignments and acts. Like Somalia for instance.
Lest you forget, an ABSENCE of the president signing off on an order caused the abortion of the hit on osama bin laden....BEFORE 9/11.

All Rhodes has to do is disobey the Army order. If they Court Martial her, then the burden of proof falls on Obama. Game over, cos he can’t produce a US birth certificate. The Judge can be as pernickety as he wants, but he should know that this case is going to keep coming back to him till Obama fails to prove his Natural Born Citizen status. Moreover, the chain of command is criminalising itself, if they have good reason to believe that their orders are from an illegal source.
And the dude on the couch he’s snuggling with is a Pakistani, who was (is?) a drug dealer, and now lives in Seattle involved with local theater. Ahem.

”3. If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.”
It PLAINLY states that a qualification is met OR the Vice President is President until a "qualified" President is chosen by Congress. It doesn't say "Congress can ignore this provision and allow the "unqualified" President elect to be sworn into office."
Obama either has met the eligibility requirements with a legitimate birth certificate or he is a usurper, and this provision is being ignored by Congress. If he is not legal, he is not President and is not entitled to any legal protection the office itself might afford him.

Well the COLB is available at dozens of sites now, but my hazy recollection was that he originally posted it on his campaign site. Is that wrong?
I understand that the plaintiff normally bears the burden of proof. But this is a case where the defendant (Obama) has blocked or seeks to block access to decisive evidence (his long form BC and/or other documents) that would establish or negate his constitutional qualification as NBC to be POTUS.
In all fairness the mods have gotten much better as of late. They boot out the new ones really quick which is what we need.
The problem is the long time duds like non-sense-itor and several others.
For some reason if they have an entry date that goes way back they get pass after pass.
Hopefully, as things heat up and we need all the cooperation we can get here on FR, the mods will take care of these age old problems as well.
I gave up recognizing, responding or getting involved in any discussions with them. Worked for me, even though I get tempted, but YMMV.
FR is a key website in the fight to keep the country free from the commies. We don't need a-holes mucking it up day after day. And, some of the heavy hitters that view this site don't want to wade through it either.
It actually gave me a headache (literally) having to skip most of his posts...
