The Commercial Appeal ^ | May 21, 2005 | Lawrence Buser

On a winter evening last year a veteran sheriff's deputy pulled over silver Chevy Malibu for speeding on I-40, hit a jackpot.

...found 33 pounds of cocaine worth more than $ 1 million dollars on the street...

Criminal Court Judge Paula Skaham ruled that the deputy questioned and detained Berrios too long for a routine traffic stop and the driver did not appear to be nervous enough on the officer's dashboard video to suspect criminal activity...

This is exactly why we do not need liberal judges.

Kinda brings the current battle in the Senate into perspective, doesn't it?

Would like to see the President re-nominate Judge Bork to the SCOTUS and watch Reid, Schumer, et al implode!

Good for this judge. I see nothing at all liberal in upholding the 4th Amendment (for a change).

It's time we started impeachment against judges.

---he driver did not appear to be nervous enough on the officer's dashboard video to suspect criminal activity...---

This judge does not appear smart enough to suspect mental activity...

From the article:
"The law and the Fourth Amendment (against unreasonable searches and seizures) are not meant to be get-out-of-jail-free passes," said Smith, who is appealing Skahan's ruling. "Laws are there to protect the citizens of Tennessee from persons possessing 33 pounds of cocaine."

I beg to differ. 33 pounds of cocaine is bad. Tyranny at the hands of the State is worse.

"a veteran sheriff's deputy"

Interesting the article makes this distinction. A veteran as opposed to just a sheriff's deputy. The cop must have "smelled" something fishy when in close contact with the driver that made him suspicious.

The Left loves criminals.

what the heck!

an officer pulls someone over... he suspects from the way they are acting that they are hiding something... after searching the vehicle... sure enough he finds something!

then the judge throws it out !

remove that judge from the bench!

Exactly!

Yet even a surprising amount of (conservative?) FReepers will slam the judge for throwing out a case where the item in question was obtained by illegal search and seizure.

No reason to be alarmed. They are just getting prepared for Partiot Act II where being anything other than a sheep who follows orders will get you in trouble.

Oh....I thought we were already there!

Sad when what is SUPPOSED to be the virtual rampart of freedom reads more like the Mein Kampf cheering section. :(

.....Should say "liberal" judge.....

That might not be true. She might be a good old fashioned corrupt judge in the employ of the Crack Dealers Association of greater Memphis.

It's definitional to me. If they release criminals for no reason, I consider them "liberal."

Your right, the LEO that conducted that illegal search and seizure shoul have been locked up. But, then they protect their own.
