WASHINGTON — Millions of parents refusing to pay child support may have their Supplemental Nutrition Assistance Program (SNAP) eligibility revoked after the US Department of Agriculture rescinded a Biden administration rule earlier this month, The Post has learned.
The move, which revives a policy implemented during the first Trump administration, could save taxpayers billions of dollars per year in money that’s formerly gone to delinquent child support payees.
“This is not about kicking people, who truly can’t afford to make payments, off SNAP,” said Alex Adams, assistant secretary for family support at the Department of Health and Human Services’ Administration for Children and Families. “It’s about getting people to have a plan in place so that they can fulfill both their legal and their moral responsibility to their children.”
Under former President Joe Biden, the USDA’s Food and Nutrition Administration had, in Adams’ words, “shut the door and basically discouraged states from using” child support delinquency to disqualify would-be SNAP recipients, pursuant to a June 6, 2024, memo.
Only Arkansas, Kentucky, and Mississippi had implemented any restrictions as of the following year, per a 2025 State Options Report published by the USDA.
The Biden-era guidance was rescinded in a July 20 memo that allows states to strip SNAP benefits from parents without primary custody who are supposed to pay child support — and are failing to do so.

I don’t understand why the benefits aren’t capped for only 2-3 kids at the most. There is a woman with 10 kids, pregnant with triplets who was on YouTube and was bragging about spending thousands of dollars of taxpayer money are Costco every other week to feed those kids who apparently were immaculate conceptions since there is no daddy around.
These freeloaders feed their children, cheap junk food and take the rest and buy drugs, liquor and cigarettes.

* Household of 8: **$1,789/month**
* Plus 3 additional people × **$218** = **$654**
* **Maximum total: about $2,443/month** ([fns.usda.gov][1])
However, **very few households receive the maximum**.
SNAP benefits depend on:
* Household income.
* Countable assets (in some cases).
* Housing costs.
* Child care expenses.
* Other allowable deductions.
The basic formula is:
> **SNAP benefit = Maximum allotment − 30% of the household’s net monthly income**. ([fns.usda.gov][2])
So, for example:
* **No countable net income:** about **$2,443/month**.
* **Net monthly income of $1,000:** roughly **$2,143/month**.
* **Net monthly income of $3,000:** roughly **$1,543/month**.
A household with 10 children may also qualify for **other assistance programs** (such as Medicaid, WIC for eligible young children, free school meals, or tax credits), but those are separate from SNAP. Eligibility and benefit amounts vary based on income and state rules.

States *may* hold parents who don’t cooperate to get orders, or who don’t pay these orders, in violation and curtail their SNAP.

Makes sense. Now how about a law that allows that child support to go into a special fund dedicated to what the child needs? As it is now child support money basically goes into the household accounts and spent for whatever the custodial parent decides. Trust me it does not all go to what the child needs.
