An armed Florida homeowner fired shots in self-defense amid a burglary attempt Wednesday night, the Nassau County Sheriff’s Office said.

Deputies responded just before 8 p.m. Wednesday after a homeowner reported two suspects attempted to break into a house on Clearwater Road, officials said.

The homeowner fired a gun and struck a juvenile male suspect, who was later transported to a local hospital, where he was in stable condition, officials said.

"Anyone who breaks into someone's home should expect to get shot," Sheriff Bill Leeper said. "This is a serious crime with real consequences."

I hope this gets shot down but I doubt it will.

“Colorado Democrats have introduced a bill to get rid of Stand Your Ground here.”

Democrats just don’t want you shooting their voters.

It depends on the situation and location. If you are in my house in Texas without my invitation I can shoot you anywhere on your body I want to. If you are stealing my property after dark, I can shoot you.

Sheriff Leeper is as good as Grady Judd, the Sheriff of Polk County.

“If you are in my house in Texas without my invitation I can shoot you anywhere on your body I want to.”

Wish it were that easy sometimes. But the use of force in Texas is still determined by the need.

According to the Texas State Law Library discussion:

Self-Defense - Texas Penal Code § 9.31
A person is justified in using force against another when he reasonably believes the force is immediately necessary to protect himself against the other’s use or attempted use of unlawful force. A “reasonable belief” is one held by an ordinary and prudent person in the same circumstance as the actor.

But care is not limited to just one law concerning the castle doctrine. The castle law is straightforward in its application, and while it does grant extensive use of force in the exact circumstances outlined by the penal code, most other uses of force will be judged based on the force necessary to prevent or stop a crime from occurring. The force that is necessary, or reasonable, depends on the situation and is governed by a variety of laws in the Texas Penal Code.

So opening fire on a person for just being in your house without an indication of threat to harm and when they are retreating as the shot would have been in the back, is not reasonable force necessary commiserate with the crime of trespass. There is no threat. If you take the shot, your lawyers will have to prove it was necessary for protection.

A good case on this is here:

“Even in MA, the rules have changed. It used to be you had to “retreat” before shooting. It was changed to assume that someone breaking into your home is going to harm you.”

That’s been the law in NY forever.
