Migrant truckers sue California DMV over canceled commercial drivers’ licenses

The California DMV is facing a lawsuit brought on behalf of nearly 20,000 immigrant truckers over the state’s plans to revoke their commercial drivers’ licenses (CDLs).

The Asian Law Caucus and the Sikh Coalition, along with the law firm Weil, Gotshal & Manges LLP, filed the lawsuit on Tuesday in an effort to stop the California DMV from canceling the CDLs, which the complaint says would “result in mass work stoppages” starting Jan 5, 2026.

“This class-action lawsuit is brought on behalf of the Jakara Movement and five commercial drivers who have been deprived of their rights and livelihoods,” a joint statement from the Asian Law Caucus and Sikh Coalition said. “According to reports from the San Francisco Chronicle and KQED, California state officials communicated they would begin reissuing licenses on December 17. Despite these public assurances, the state has neither reissued any of the contested licenses nor created a process to remedy the date issue with no indication that it plans to do so before January 5.”

The lawsuit alleges that on Nov. 6, the California DMV notified 17,299 immigrant drivers and business owners that their non-domiciled CDLs would be canceled on Jan. 5, 2026, due to an error with the expiration date of the licenses.

A similar letter was sent to an additional 2,700 drivers in December, informing them that their licenses would be canceled in mid-February.

The DMV is required to set the expiration date for a CDL given to an immigrant on either the same day or before the expiration of the driver’s work authorization or legal presence documents, according to the lawsuit.

However, the lawsuit alleges that the DMV letters violated California procedure, which would require the department to either cancel the license without prejudice or change the expiration date.

... any lawyers that would take a case that involves an illegal bringing suit against any USA institution should be put in the stock for a considerable time.

The only ‘right’ any illegal has is the right to not be shot on sight. Try ‘accidently’ crossing the border is one of the koranimal countries. You would disappear - literally. Your corpse would be tossed into a ravine to feed the night creatures.

Our legal system is composed of the law and precedent. When California issued CDL’s to illegals they set a precedent. A precedent can be used to modify the law. For example, a town enacts a law to prevent people from walking their ducks after sunset. (As I recall, that’s an actual law somewhere.) For decades people walk their ducks after sunset and do not get arrested or fined. Then, one night, someone gets arrested and charged. The lawyer for the duck walker would argue that the law was rendered null and void and his client is the subject of selective enforcement. (Not legal advice. Don’t walk your ducks based on a Free Republic post.)

I don’t think the truckers have a good case, but this is California. They’ll probably get a ten-billion-dollar settlement.

I think government has control over the ability of one to sue and get to trial which is what this case could reset the “bar” so to speak 🤣🧐🧐

The law firm realized there was a tremendous opportunity here.

By persuading the driver unions to sue, the lawyers developed an unending revenue stream from a class action that can go nationwide.

And, while the lawsuit is in process, the lawyers will argue that the illegal alien drivers cannot be deported

That is a part of the answer as they need to be
educated enough to understand laws, etc. which
include rules of the road, etc. It wouldn’t be to
far down the road with computers to give them
a detailed route as they proceed on the road.

Aliens protesting in America should not be allowed. It is not allowed in other countries. This lawsuit is really a protest disguised as a lawsuit. Send them packing for bitching about the laws in America.
