A federal judge threw out the indictments against James Comey and Letitia James on Monday, finding they were illegitimate because they were brought by an unqualified U.S. attorney.
Judge Cameron Currie dismissed the false statements charges against Comey and bank fraud charges against James without prejudice, meaning the charges could be brought again.
"I conclude that the Attorney General’s attempt to install Ms. Halligan as Interim U.S. Attorney for the Eastern District of Virginia was invalid and that Ms. Halligan has been unlawfully serving in that role since September 22, 2025," Currie wrote.
The Department of Justice could appeal the decision or attempt to bring the charges again with a different U.S. attorney. Fox News Digital has reached out to the DOJ for comment.

The charges against Comey were for his September 2020 testimony.
It is now November of 2025.

On what basis do you expect a reversal on appeal?
Here’s my understanding, please correct me if I’m wrong:
1. The position of U.S. Attorney is subject to Senate confirmation. At present, there is no U.S. Attorney for that district who’s been confirmed.
2. To make sure that the office keeps functioning while the Senate process is going forward, the Attorney General can appoint an interim U.S. Attorney.
3. BUT to make sure that the requirement of Senate confirmation isn’t permanently bypassed, interim appointments can’t last more than 120 days.
4. If, after 120 days, there’s still no Senate-confirmed U.S. Attorney in that district, then the district judges get together and appoint an interim U.S. Attorney.
5. At the time Halligan signed these indictments, it had been more than 120 days since there was a duly nominated and confirmed U.S. Attorney in place. Therefore, neither the President nor the Attorney General had the authority to make another interim appointment — which is what Halligan was.
So, why was the judge wrong — other than saying that we think Comey was guilty?
I think there could be some value in empaneling a special grand Jury regarding Comey, not to indict, but for fact-finding that could later be published.

The charges were not dismissed because they were baseless, they just said the prosecutor wasn’t correctly appointed.

Is for the statute of limitations running out well how do you have a statute of limitation when the person in charge of who should be investigating is the one being investigated
It’s good to be in the club. No democrat will face justice for anything. They know anywhere they commit their crimes is run by a “judge” who will just throw out any charges against them. “Dang it feels good to be a democrat”
I do not know that Comey is guilty or not. I have confidence that Pres Trump and his team would not have prosecuted knowing all that was the case. As has been the case since 2015, my money is on Trump. Watch and learn.

Comeys current charges are passed the statute of limitations now.

The main issue here is Trump’s team. I don’t expect Trump personally to know all the details of the law about appointing U.S. Attorneys. As others in this thread have noted, Bondi really messed this up.
That said, I do think Trump could do a better job of selecting his appointees and overseeing their work. Musk is another example.
