What to Know About Project Firewall, the Trump Administration’s H-1B Visa Probe

Companies could face probes into their compliance with the H-1B visa program as part of the Trump Administration’s effort to clamp down on the program and force companies to hire more Americans.

The Department of Labor announced on Friday that it was launching Project Firewall, an “enforcement initiative” that will investigate employers for potential abuse of the H-1B visa process. The initiative may be the first time the federal government has sought to broadly enforce H-1B legal standards intended to protect both the H-1B employee and American workers, such as paying wages on par with other workers of similar qualifications or with the local prevailing wage and offering benefits on the same basis as for U.S. workers. Some employers are also required to have taken “good faith steps” to recruit American workers for the job before petitioning for H-1B status for an employee. Since the program began in 1990, suspected noncompliance has typically been investigated case-by-case based on complaints from workers.

My question is, will the Department of Labor be looking into hiring discrimination as part of the H-1B investigation? In particular, favoring out-of-country candidates over citizens based on ethnic origin?

Data point: I had been hired by a company as a contractor to clean up their customer-facing documents (English language). When my time-based contract expired, they did not renew, nor offer full-time, because I was not born in India. My contract contact, a Maine woman, left the company and started another job according to her LinkedIn.

(Who knows what evil LURKS in the heart of the H-1B problem? Where is The Shadow when you need him?)

The enforcement will continue as long as voters are paying attention.
Once voters attention heads elsewhere, it’ll be back to business as usual. Gotta keep the donors happy.

For decades, the US H-1B visa has been the gateway to the good life....... but not for Americans:

I don't see American India Express in that list. Here in Phoenix, the entire corporate campus is H-1B.

Infosys has a 160,000-square-foot office building on ASU campus. Part of a long-term
partnership to accelerate workforce development. Sure. More like an H-1B factory.

This form of worker replacement visa is a curse on the US STEM workforce. The H-1b visa blight may be ending. Celebrate!

Another way the parasites thwart US law.

Building a residential development that exclusively sells or rents to people of a specific ethnicity is illegal in the U.S. under the federal Fair Housing Act (FHA).

As for Texas housing developments being built for “Indians only,” reports and developer websites show new residential projects cater to the visa-holding Indian community by emphasizing cultural and social aspects.

Even if Trump manages to restore h1b to its original intent - finding true talent that can’t be found here and puts guardrails around it, as soon as the Democrats are back all that will go out the door in an instant.

Of course. The problem for both parties is guest worker visas may become an 80/20 issue before the Donks can return H1B to business as usual.

Work visas cannot be fixed. They need to be shutdown.
