State Attorney General Letitia James’ attorney blasted the Trump administration Thursday for using “cherry-picked” information against her in a federal criminal referral — although she admitted to “mistakenly” listing a Virginia home as the Democrat’s primary residence.
In a fiery, five-page letter to US Attorney General Pam Bondi, James’ lawyer Abbe David Lowell picked apart the accusations that James committed mortgage fraud, calling the referral a meritless, hypocritical salvo in President Trump’s “revenge tour” against the prosecutor.
Federal Housing Finance Agency Director William Pulte’s bombshell criminal referral was based off shoddy media reports and a selective reading of public records, Lowell argued.
Among the allegations outlined in Pulte’s referral were that James listed a Virginia home more than 300 miles from her New York City office as her “principal residence.
That document cited a power of attorney document from 2023 signed by the AG authorizing the purchase of the property, in which she attested “I hereby declare I intend to occupy this property as my principal residence.”
However, Lowell chalked this up to a clerical error, and accused Pulte of selectively including it to bolster his accusations.
“Director Pulte cherry-picked an August 17, 2023 power of attorney that mistakenly stated the property to be Ms. James’ principal residence and at the same time absolutely ignored her very clear and all caps statement two weeks earlier to the mortgage loan broker that ‘[t]his property WILL NOT be my primary residence,’” the letter said.
Another accusation Pulte included in his referral letter was that James, whose salary is $220,000, misrepresented the number of apartments in a building she has owned in Brooklyn since 2001. Pulte claimed James said the building only had four units, but pointed out that the NYC Department of Buildings records says it has five.

New York Attorney General Letitia James has tapped criminal defense attorney Abbe Lowell — who previously defended Hunter Biden against federal tax and gun charges — as she fights mortgage fraud allegations. Lowell, a partner at the Winston & Strawn LLP law firm, was hired by the Office of the New York State Attorney General and not retained personally by James, according to the Times Union. The decision to hire Lowell, a prominent white-collar defense lawyer, was based in part on the AG’s office belief that the bombshell criminal referral filed by Federal Housing Finance Agency Director William Pulte earlier this month was directly correlated to the civil fraud lawsuit James’ office brought against President Trump last year, the outlet reported.
James is accused of falsifying records to get home loans for a property in Virginia that she claimed was her “principal residence” in 2023 — while still serving as a New York state prosecutor, according to Pulte’s referral to the Justice Department. Pulte also alleged that in February 2001, James purchased a five-family dwelling in Brooklyn but has “consistently misrepresented the same property as only having four units in both building permit applications and numerous mortgage documents and applications.”
Lowell is representing James as a private citizen, not as a member of Winston & Strawn LLP, according to Fox News. On Thursday, Lowell attempted to poke holes in the allegations in a letter to Attorney General Pam Bondi. He also argued that the accusations are nothing but “retribution” from Trump against James in the letter.
It’s unclear if New York taxpayers will be footing the bill for Lowell’s legal services. The DC-based lawyer reportedly “charges a rate of $855 per billable hour,” a figure that was cited by an attorney for Lunden Roberts – Hunter’s baby mama...(Excerpt) Read more at nypost.com ...
