I’m not aware of a 1948 court decision.
I am aware of Mississippi v Johnson (1867) in which the Supreme Court made it explicitly clear that the Judicial Branch had no say in how the Executive Branch chose to carry out its duties.
I think we are pretty much at the point where Trump should announce that no court has any power over his Branch. And I think that includes the Supremes. Roberts? He’s a nobody.
That would be fine when foreign policy matters or non-US citizens are concerned.
But the executive branch can not willy nilly disregard citizen’s rights. Okay the Mar-a-Lago raid crossed the line.
I agree with both of you.
So unless he’s secretly given them a big ol’ “F.U.” that none of us have seen or heard about, why is he complying with every single TRO or injunction issued?
I’ve read all over the Net about a supposed EO he signed, stating that he was going to ignore asinine District Court rulings. Then, a heartbeat later, someone says it’s fake news, and that the White House only issued a Memorandum stating the administration would demand that the filers put up or guarantee a large amount to cover potential fees, penalties, and court costs. (I’m paraphrasing, btw). So which one is the truth, I wonder?
Appeals can go quickly, or they can take years. This insanity has to be stopped before things deteriorate to such an extent that the only option left is the unthinkable.
That would be a very bad thing.
Since the “executive branch” “executes” the laws, then the courts, indeed, have zero power.
exactly, the court wouldn’t be shy about telling the executive branch or the congress to pound sand if they attempted to infringe on their powers!
Why bother going back to the USSC since the 1867 decisions already confirms Trump the power he needs. He should simply ignore the judges. I do mean ignore, too. In law, no one must respond to any unauthorized requests or demands.
