President Trump vs. District Judges

Posted on 03/19/2025 2:48:06 PM PDT by 7thson

Question for everyone.

Why can't the Trump administration basically inform these courts - by a nationwide press conference/speech, by a letter, and/or in person DOJ attorneys - that because of the 1948 Supreme Court decision, the only court that the President will pay attention to is the USSC. That this administration will continue to do what it is doing and lower courts have no lawful basis in attempting to dictate Executive policy?

I'm going out to dinner now and will read your responses upon my return.

Simply use the “You have NO standing” argument. It seemed to work so well when used BY them, and turnabout is the definition of fair play.

Basically, just tell them to pound sand.

Maybe it’s a Rope-a-Dope strategy. Get Rat-supported judges to say and do outrageous things and make it a midterm election issue.

Everybody knows that. That is why the local Obama judge is overstepping his jurisdiction.

Because Republicans are timid and are delusional in thinking they will be respected by the media by playing nice.

I would think Trump has ability for next SC appointment to appoint someone to take over as Chief Justice, bumping Roberts out of that seat.

Doesn't work that way. Roberts has that job until he dies, retires or is impeached by the House and is convicted and removed by the Senate.

“”Our three co-equal branches mean nothing if this is the way it’s going to be. Nothing works and everything breaks down if this isn’t turned around and quickly. This makes our govt illegitimate to it’s core and the people should never have to obey an illegitimate judiciary.””

Our dysfunctional judicial system is making America the laughingstock of the world. We haven’t had a “representative republic” for some time now, and Trump’s election is probably our last chance to get that back. No doubt the rest of the America-hating world is probably enjoying the show... as is the Democrats.

This part of the constitution talks about judge’s salaries.

It takes money to operate a court, different area of the budget.

Congress can defund the courts, but not cut salaries of the judges. They can freeze them, however...

Yep. If I were Trump, I would’ve immediately “reassigned” both the DC District judge, as well as the 9th Circuit Court judge.

Why bother going back to the USSC since the 1867 decisions already confirms Trump the power he needs. He should simply ignore the judges. I do mean ignore, too. In law, no one must respond to any unauthorized requests or demands.

This is the argument that I've been making. Congress has the authority to establish and abolish all courts lower than the Supreme Court. In theory, Congress could abolish the entire judiciary below the Supreme Court and create a whole new judiciary based on different districts. Trump would then appoint all the judges in the new judiciary with the consent of the Senate.

The judges of the old judiciary would then trek down to the unemployment office.
