They have to release the prisoner.

Well, they still have to process the paperwork, etc. It’s not like picking your kid up at school early.

Someone said that the pardon was only valid if the person had already been convicted. Can anyone confirm this?

They should be free immediate.

I hope they have a basis for suing the prison system and the individuals within the system for mistreatments.

I think it will be interesting when J6 starts alleging mistreatments by the guards. They should lose their jobs and be banned from the federal system.

No Nixon was pardoned and there were no official prosecutions existing at the time of his pardon. They were imminent but not officially commenced in the House

Not in this case... “Free to go” means Free to go... If DC wants paperwork they can chase them down later if it is that important to them. Here is the deal, they are going to try and force them to sign non-disclosures about their treatment before they release them. Right now at this point that would be extortion and coercion if they detain them. They are free to go without any restrictions or delays.

Ford's pardon was never tested in court. Can a President pardon crimes that haven't been charged yet? I don't think so. This sounds like the Pope practicing indulgences back in the 1400/1500s.

I don’t know if you can refuse a pardon. A governor(?), I don’t think it was Biden, gave pardons or commutations to some Death Row inmates and got them down to “life”.

Two of them are having their lawyers try to stop it. They are on a list to have their cases looked over again as they claim their innocence. Death Row inmate’s cases are put to the head of the line. They will be sent farther down on the list of reviews if they are off Death Row. (They have already been waiting for years.)

Someone needs to tell the jails around the country that refuse to release them. DC jail was surrounded by police.

That is true...

But these folks are all being forced to plea bargain for a lesser charge and accept guilt anyhow even though they are not. So it is a catch 22 situation, lesser of two evils. I would rather be falsely considered guilty and out with no more court process than have to plea bargain for a lesser guilty charge and prison time anyhow.

If they turn down the pardon and stay and fight it they will never get out and be found guilty anyhow. The system is broken, once you are even accused you are considered guilty and almost always have to take a plea and confess guilt for less punishment guilty or not, there is no such thing as innocence anymore. Only millionaires with influence are ever found innocent.
