INDIANAPOLIS — a 29-year-old man was kiIIed following a road rage incident captured on a witness’s cell phone.
The incident was deemed self-defense and the shooter was released without being arrəsted.

The guy who filmed the shooting was himself shot dead the next day. He was an advocate for non-violence.

Agreed. But not establishing if the gun was pointed in his left hand at the truck indicates a lack of force. And like I mentioned in another post, anger is not grounds to irrigate the stand your ground scenario. It requires imminent threat to self or property (in many states on the property) All you can see on the film is a pissed off guy that has confronted a person. The weapon is not part of the equation until it is brandished. Brandishing is defined as to wave or swing (something, such as a weapon) in a threatening or excited manner. Without seeing the position of the gun behind his body, he didn’t fill that block.

Believe it or not, the guy video-taping was killed the next day at a gas station. He was actuality an anti-violence, anti-gun radical.

We never saw the peson outside the car ever point the weapon at the shooter in a theatening manner. If he has a permit and did not brandish the weapon, which we can’t see he did, then he can carry the weapon anywhere he wants to go unless the law over rules him like maybe school property as an example.
I saw no threat from the film. There would have to be more aggressive actiuon with the gun to get the threat existance to go. Civil trial, not criminal.

A road rage incident where dark sedan pulls in front of a white pickup, stops and the driver exits the sedan with gun in hand, approaches white pickup in threatening manner. Whammo, boom boom....A perfectly legitimate shoot!
When such videos are presented, the discussion always focuses on the justification or morality of the shooting incident. This is fine, but we should also discuss the fight itself. Here’s what I told my wife and my people if they will listen. Please correct me with my thanks.
1. Road rage can be deadly. Don’t be involved on either side.
2. Assume that the other person has a gun!
3. Use your car. Most states are making laws now regarding driving over or through someone who is in your way to assault you. Perhaps the shooting is justified but he will be sued, and it will be expensive. The question I have about this video, which someone on the civil trial jury will ask is, “Should he not have driven out of there rather than stay to shoot?” Never mind what ought to have happened, he is going to pay maybe $20,000 dollars to a lawyer during the course of the civil suit, and if he loses, the lord only knows how much.
4. Only the lawyers win, so do not play the game. Drive to the police station or the fire station instead.
5. Get video. This man was not arrested because somebody took this video. Otherwise, he would be in jail!
6. First one to 911 wins. While moving on the road call 911 and ask what to do. Report “aggressive driving”. Drive to meet a cop who will then be aware who you are and what you look like and what the Road Rage person looks like.
It should not be this way, but we voted for the people, the lawyers who did this to our system of law. Passing “Stand Your Ground” may be a step in the right direction. Each community should identify “aggressive driving zones” and focus enforcement there. Like setting up a trap by the bar at closing time. It is not rocket science.

I agree. Depending upon the skill of the DA and the ignorance of the jury, this guy could go to prison.

You were right up to this point. You’re assuming he was thinking of using the gun, which he did not nor the evidence says now made any offer to shoot his gun. He had it, he tapped the truck with it, he changed hands with it, and he lowered it. The weapon was neer discharged nor wa an effort to do so observed. If he had carried a baseball bat or a rock with him, is that a threat? Legally, just as much. Don’t assume by guessing what might have happened. You can only work with what you did observe. So unless you, without seeing or hearing it, get the gun pointed at the driver or the vehicle and/or hear him say he is going to use it, you have only assumption and that’s not fact. And remember, this is not a criminal trial which requiires beyond a shadow of a doubt but requires a preponderence of the evidence with a civil suit. It is not cut and dry. Remember OJ, same type of undertaking.

He was released without bail and no court date has been established. And you’re right if the DA wishes to push the issue. Doesn’t look like it.
But what I’m talking about is a civil suit that could cost the shooter millions for wrongful death. Suing is the national sport for many in the US so I wouldn’t put it past them. And OJ really put this into the news and it can be profitable.

LOL...If some maniac don't like the way I'm driving, and jumps out of their vehicle at a stop, with a gun in hand and approaches me sitting in my vehicle, I'll dump an entire mag on them if at all possible.
Hey whitney, if some lumberhead is road raging at you and then approaches your vehicle in a threating manner with gun in hand (If they have gun in hand coming at you, that is as threatening as it gets) are you going to wait to see if they're going to put a bullet through your head before ya drop them?

You really have no idea the amount of time it takes either raise or point a gun held at the ready do you? Pray you never have to find out because it is an insane small sub-second.
