Fine if it was sold as “pistachio-flavored”.
Otherwise, she’s got a case.
Especially poor form from a supposedly premium brand.
That’s nuts!.................
Doug Ducey’s company.
Bland, boring, flavorless crap with a cute name and nice outlets.
Same guy who squished out when the Rat filth stole the election in Arizona and he did nothing. Then let Kartel Katie run off with the governor’s office that Kari Lake DID win.
Does it contain ice and cream, or is it luke warm bug juice with chemical pistachio flavor?
Sounds like she has plenty of nuts. As in she is nuts, unless the USSC deems that she has a case and will revert to the lower courts for final decision.
This case should no nowhere. The company publicly post their ingredients. They made no false statements. Its not like the Subway suit where they were selling 10 and 11 inch footlong subs.
The old saying applies, "Buyer beware".
If your product contains nuts, you could face a lawsuit.
If your product does not contain nuts, you could face a lawsuit.
Normal people buy a container of ice cream once, shrug, and say “I thought it would be better than this.”
Nuts are different.
Perhaps the reasoning is if customers are willing to shell out $7.50 for a small scoop, they can be treated like chumps.
Wonderful.
Gerber’s is next. For years they’ve been selling baby food with no baby in it at all.
What does this Eden Hernandez have to do with anything. Gawd save us from all this incompetent journalism.
First world problems.
“This case should no nowhere.”
Judge disagrees,
“The company publicly post their ingredients.”
Store label is misleading.
“Yesh, a manager...said the flavors are artificial because some people are allergic to or don’t want nuts, even in their pistachio ice cream.”
So, does that go for Chocolate as well? For those people that want chocolate, but alergic to it?
Another grifter and low life lawyer looking to hit the lottery on a technicality if you ask me......and I’ll go one further.....the whole thing is probably the lawyer’s idea.....the “plaintiff” is just a means to an end.
If it was labelled “pistachio ice cream,” there had better be pistachios in it, either finely ground or in pieces. And there should be cream in it, too.
And while on the topic of false advertisement, companies should not be allowed to label non dairy products like almonds and water as milk of any kind, either.
They should have labeled it pistachio-flavored.
LOL dog food, cat food too.
Makes sense that there are no nuts.
It’s a conspiracy.
Frivolous lawsuit will get thrown out. Another ploy to get “free money” from a deep pocket without contributing one dime to increasing the value of the economy. These grifters and their lawyers make me f’n sick.
