That's not was Elon said. He said if someone tears down the American flag and puts up another flag in its place. It's assumed - by anyone with an IQ over 50 - that he means tearing down someone else's flag (there's no problem with tearing down your own flag and replacing it with another).

The Supreme Court ruled that desecrating the American flag was free speech around 1988. Up until then, it was a crime.
