I hope you are sitting down when you read this article.
There is absolutely no way I can possibly sugar coat this, so I’ll just be frank… The NYS Supreme Court Appellate Division’s Fourth Judicial Department has issued their ruling in our quarantine lawsuit against Governor Hochul and her Department of Health, and they have ruled against the will of the people!
If you feel like you just got sucker-punched in the gut, join the club, my friends.
The court has dismissed our lawsuit, not because we are wrong in our arguments… no, no, indeed we are dead-right. In fact, the court did not even touch the merits of the case. How could they? Instead, the court unbelievably ruled that my plaintiffs somehow do not have standing to sue! If your brain is racing a hundred miles an hour right now trying to figure this out, don’t worry, you are definitely not alone. Every single person I have told about this court ruling, from my plaintiffs, to fellow attorneys, to family members, and so on, has been downright flabbergasted. Rightfully so. One of my family members told me I needed to break it down for her, like she was a Kindergartener. I’ll do the same for you now, because this issue is so crucial for you to understand, and then for you to explain to others.

New York once again has the dubious distinction of being labeled “the least free state” in America, according to a report issued by libertarian-leaning think tank The Cato Institute.
The Empire State ranked dead last — 50th — for policies impacting economic, social and personal freedoms in 2022, the report claims.

Yikes.
Two quickies:
1) Courts are not subject to "the will of the people", but to the Constitution and the laws.
2) If NY courts WERE subject to "the will of the people", what makes you so sure they would rule in your favor?
Make NYC one. No one in or out. Quietly alert the good ones at Fox, WSJ, etc first.
Fun fact: concentration camps were at first justified in the interest of public health and sanitation.

thus paving the way to forcibly incarcerate any NYS citizen who resists the Governor/ and her Health Department whatever they wish to bring up charges without "due process".
This is the same Health Department that wants to rule on firearms possession as a 'health issue'.
Maybe the next week this program is enacted,it will be charging persons who are in political opposition to the ruling party ?
You can legally sue, but that requires the services of a costly lawyer to regain your freedom, after the fact, after incarceration.
Tell that to the J6 political prisoners held in Washington (!!), who are held in isolation, solitary confinement, with minimal visitation and allowed very few phone calls.
This is such a potentially egregious violating as to defy all Constitutional rights and values.
Sounds like a great way for police to get themselves shot. The way around anything like this is, if they attempt to implement it, take out the enforcers. s like
Fascism in America.
We did over three years ago and boy, are we glad we did.
When NY passed and celebrated the horrific abortion law that allowed for abortions up to the moment of birth, I told mr. mm that we needed to get out of the state. That was before cuomo resigned and hochul was installed.
I didn’t think anyone could be worse than cuomo and was I ever wrong! Glad to be in the Live Free or Die state of NH.
Well if they don't want to stand then maybe they need some help with laying down and not getting up...
