Elena Kagan, Sonia Sotomayor trade jabs in Andy Warhol copyright case

Supreme Court Justice Elena Kagan appeared to take umbrage at Justice Sonia Sotomayor’s majority opinion in a copyright case involving Andy Warhol and Prince, telling readers in her dissent that she would trust their “good judgment” rather than counter her colleague’s “fistfuls of comeback footnotes.”

The shot at Kagan’s fellow liberal came in a lengthy second footnote of her dissent, which several Supreme Court observers found “interesting” and “noteworthy.”

Kagan and Chief Justice John Roberts were the only justices that didn’t rule in favor of music photographer Lynn Goldsmith’s claim that the the Andy Warhol Foundation for the Visual Arts improperly licensed a work by the famous pop artist which used a photograph of the late musician Prince taken by Goldsmith.

I have not looked at these decisions in this light, altho I agree that brevity has been lost. I have not seen a change in philosophical approach by individual justices that I can trace to a change in the style of opinions. Then again , I have not endeavored to seek out this connection.

This kind of garbage is why SCOTUS is “too busy” to see 1st and 2nd amendment cases???

It might not be "garbage."

If there's a question in copyright law (or in any area of law) that is ambiguous, then it's the job of the USSC to clarify it, and thus provide guidance to lower courts on how to rule when this question arises again in the future.

5 unelected, unaccountable megalomaniacs collude together to decide the most pressing issues of the day with no input whatsoever from the voters or their representatives. In a country of 350 million, we have 5 people deciding the law, and creating law from the bench. That is not a democracy and it is not a republic folks. It is not what the Founders intended.

Congress passes a law banning fag marriage and the President signs it? TOO BAD! FAGGOTT ANTHONY KENNEDY SAYS YOU GET FAG MARRIAGE ANYWAY!

Just one example of how insane this system is.

Interesting. So, it looks like a 7-2 decision, with Thomas, Alito, Gorsuch, Kavanaugh, Barrett, Sotomayor, and Jackson in the majority and Kagan and Roberts in the minority.

It is superficial because we are ALL getting ripped off financially because of a fraudulent election that they chose not to get involved in.
