Do Second Amendment “Arms” Include Cannons? I would appreciate any additional materials that anyone may have.
“Congress have no power to disarm the militia. Their swords, and every other terrible implement of the soldier, are the birthright of an American... The unlimited power of the sword is not in the hands of either the federal or state government, but, where I trust in God it will ever remain, in the hands of the people.” -Tench Coxe, Pennsylvania Gazette, Feb. 20, 1788
“The word ‘arms’ in the connection we find it in the Constitution of the United States, refers to the arms of a militiaman or soldier, and the word is used in its military sense. The arms of the infantry soldier are the musket and bayonet; of cavalry and dragoons, the saber, holster pistols and carbine; of the artillery, the field piece, siege gun, and mortar, with side arms.” -English v State, Texas 473, 476 (1871-2)
“Cannon are constantly manufactured, when demanded, to a very considerable extent, in the public armories of the nation, and of the States, and on contracts, and for sale to associations of citizens, and to individual purchasers, for use at home, or for exportation.” Tench Coxe, Dec, 8, 1812, Report of Acting Secretary of the Treasury; Digest of Manufacturers; American State Papers, 1832
[11] To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water; Section 8: Powers of Congress US Constitution
Definition from Webster's 1828 dictionary (implicit ownership of cannons by private citizens): M`ARQUE
M`ARK , n. Letters of marque are letters of reprisal; a license or extraordinary commission granted by a sovereign of one state to his subjects, to make reprisals at sea on the subjects of another, under pretense of indemnification for injuries received. Marque is said to be from the same root as marches, limits, frontiers, and literally to denote a license to pass the limits of a jurisdiction on land, for the purpose of obtaining satisfaction for theft by seizing the property of the subjects of a foreign nation. I can give no better account of the origin of this word.
1. The ship commissioned for making reprisals.
No.
You can research if you want or complain I’m not footnoting everything I state for you.
If you’ll notice, the quotes I posted don’t say anything about portability, and marque and reprisal on the high seas with ships wouldn’t work with only muskets.
Agreed.
There’s an outfit somewhere here in Texas where you can go and drive and fire tanks.
So, to answer your question: nothing. Assuming you have any required (albeit unconstitutional) paperwork.
no
Excellent!
Can you document the leasing of privately owned weapons?
Superb! Where did you find this information?
ha ha! Very good.
Can you provide some documentation about the requisitioning?
I’d be happy to have the full blueprints of one.
Yes, they do.
The second amendment does not specify types of weapons other than that they are arms. Cannons are legal.
If they ever do admit that we “can have cannons”, like they can tell me what I can have, I’d like to remind everyone here that 458 Socom totally qualifies as acannon round.
Well the constitution isn’t very specific, but I don’t believe a person should be allowed to make nerve gas in their garage. A typical arming weapon by some contexts is a light weapon that you can carry around in public, not on the battlefield, for those “just in case” circumstances. I don’t think you should have to even need a permit to carry a rifle or pistol. Heavier weapons such as explosives that can cause collateral damage is another matter. Danger to the general public is a concern.
Maybe it was pirate porn?
Snickers, snicker.
Months of digging thru old newspaper archives...There are probably hundreds more cannon sales advertisements but got no time no more to do it. Many libraries have real copies of newspapers that are not On the internet,
, Some on microfilm, Some on rolls: Oakland library, Livermore .ca library ..Mormon library utah, oakland,,.ca historical society libraries have thousands of copies of old magazines and newspapers that have never been microfilm or On the internet. The internet search engines tend to censor these sources if they find them. So you have to go to the New Hamsphire. Mass, Vermont, Pa, ny hist. Society libraries and search in person.
Thanks for that info.
Mountain Howitzers can be Packed on a horse like the
Indian Wars,Beautiful piece
for Private ownership, black powder. Price is the only
Restriction I know.
I know a guy named Bud.
A former high school metal shop teacher who got the specs from the library of congress and built a 2/3 rds civil war cannon.
He had it out at my broth e r and sister in laws pine tree farm and shot it off several times.
I asked if he’d had trouble transporting it and he said oh he’ll yeah.
Also just about every small town & village in the 13 colonies has their own historical society libraries, which contain local facts about cannons, blacksmiths, pistols, etc. that cannot be found in any other hist soc. archives...have fun!
