Maxwell Mistrial?

>>Ghislaine legal team may file for mistrial if juror did not reveal own abuse when selectedJuror Scotty David admitted that he only opened up about his own abuse during deliberations when others questioned the credibility of two of the women.<<

Ghislaine Maxwell could file for a mistrial after a juror revealed he used his own experience of childhood sexual abuse to sway deliberations — and cannot remember if he revealed his past during jury selection, according to reports.

Juror Scotty David, using only his first and middle names, admitted to Reuters that he only opened up about his own abuse during deliberations when others questioned the credibility of two of the women testifying against Jeffrey Epstein’s madam.

He earlier told The Independent that the room went silent when he detailed his past, telling them that — like the witnesses — he could only remember some of the details.

He also told jurors how he’d waited until high school before telling anyone about his abuse in a way to justify why the witnesses, Jane and Carolyn, may not have come forward earlier.

The article doesn’t say how he had answered the question on the jury questionnaire. So, it’s speculation as to whether he was dishonest. But, if he lied, I think there is going to be a problem.

Your comment is correct.

And the article does not say that this juror filled out the questionnaire incorrectly or dishonestly. There is an implication that he did. But they could have also implied that the Defense dropped the ball and didn’t notice the juror’s past history. With nothing to go on, we can’t really say right now.

But people are quick to jump to conclusions.

Personally, I am opposed to questionnaires in general. They are clearly designed to get a particular outcome before the trial starts. If you can exclude certain types from the jury pool, you can mostly predict the jury’s decision before it is seated.

In one of my journeys into jury pools the prosecution sat at their table with a laptop and they questioned the jury like this: "Mr. Smith, can you tell us what happened on the night of, June 13, 1996"? They did this to 5-6 guys but the first guy was absolutely stunned. All of them said something like, "I was drunk and did something stupid ...".

How can she be convicted of trafficking minors, if she had no customers who had sex with them?

OR-— was PAID/bought to do just this, to taint the jury by the defense operatives “getting” to them in voir dire. Note that the moron juror— “can’t remember if he revealed” during voir dire! What the hell does that tidbit do except tell the public— since voir dire proceedings are done WITH an on the record court reporter. Everything said is known, including the judges acceptance of the defense and prosecution’s acceptance of the jury member selection.

This is a ploy— because certainly the reveal in a prospective juror of prior abuse would be dis-allowed by both defense and prosecution attorneys as a jury member.

Agree 100%. This is all pre-arranged. I’ve been listening to Sammy “The Bull” talk about his days in the mafia rigging juries for Gotti, and others. This is JUST like that.

The jury selection process helps lawyers and judges. Does it help everyone else?

Trials take longer
Citizens that aren’t selected waste their time

Do we really get better juries and verdicts by excluding knowledgeable citizens?

Do we not have 12 persons on a jury so that there is a reasonable expectation that one’s peers are represented?

No one has suggested "excluding knowledgeable citizens", per se. In fact, a knowledgeable citizen should, in principle, make a great juror. The selection process is supposed to exclude BIASed citizens, who are likely to ignore evidence and testimony, and instead vote based on preconceived ideas, prejudice for or against, etc.

At least, that's the theory.
