At the time, some of us familiar with the rules governing police use of force raised concerns over the shooting. Those concerns were heightened by the DOJ’s bizarre review and report, which stated the governing standards but then seemed to brush them aside to clear Byrd.
The DOJ report did not read like any post-shooting review I have read as a criminal defense attorney or law professor. The DOJ statement notably does not say that the shooting was clearly justified. Instead, it stressed that “prosecutors would have to prove not only that the officer used force that was constitutionally unreasonable, but that the officer did so ‘willfully.’” It seemed simply to shrug and say that the DOJ did not believe it could prove “a bad purpose to disregard the law” and that “evidence that an officer acted out of fear, mistake, panic, misperception, negligence, or even poor judgment cannot establish the high level of intent.”

Just like Clinton. No reasonable prosecutor would take the case…spit
You certainly implied that you would have fired under those circumstances. Interesting that you didn't deny that in your reply.
Byrd was lying. When he shot Ashli, videos showed that he was standing just outside a window of the anteroom from which Ashli was leaving. The notion that he did not glance into that window is laughable. He knew that there were not hundreds of people in the anteroom. Photos show that the hall he was in was mostly empty. He was not trapped.
Nevertheless, Byrd boasted, "I know that day I saved countless lives."
Byrd now knows that all the protesters, not just Ashli, were unarmed. He knows from the recent FBI report that there was no insurrection. Therefore, he knows that he almost certainly saved no lives at all.
The MAGA protestors were obviously not there to kill people, or they would have (1) arrived well armed, and (2) killed people.
Byrd was probably lying about having shouted warnings at Ashli. While there was plenty of ambient noise, the videos taken from inside the anteroom did not pick up those supposed warnings on their soundtracks, and apparently no one in the anteroom or in the hall heard them.
For more info about exactly what happened at the scene of Ashli's murder, read this excellent FR post by GJones2:

Someday, Michael Byrd, I hope you get the trial, conviction, and sentence you so richly deserve. You murdered Ashli Babbitt.
The media seemed quite willing to judge her intent tho. And I’m sure his defense did the same.
In the real world he would have just walked up to her, slapped on the cuffs or zip ties, and said “You’re under arrest. Who wants to be next?”
One question I have is why was he justified in shooting her when police were behind her and actually stepped back like a bunch of (fill in the blank)?
Ping!
I "Implied"?. You're the first person I've ever encountered that has telepathic mind reading abilities.
With that being said, your response to me implies that you are a homosexual looking for an argument which you're not going to get..........So what's up with that?
Officer Byrd must be an ISIS Member.
He murdered a female Military Veteran and ISIS murdered an active duty female Military Member.
It was a setup start to finish. They decided somebody had to die that day.
Jonathan Turley Calls out Concerning Comments by Ashli Babbitt's Shooter
A white woman was murdered by a black cop and the cop goes free. We live in a racist society with a racist government against white people.
>> The DOJ report did not read like any post-shooting review I have read as a criminal defense attorney or law professor.
What if it was a blank round, Turley?
The barrel of the gun was at least 4 degrees to low to hit Babbitt in the shoulder/neck.
Babbitt visibly taunts the gunman, then hops into the gunman’s line fire once he’s in position facing her point of entry. Is this something a trained AF vet would normally do? Her entry was coordinated & assisted by two clowns.
Everything points to a false flag. The wholesale reluctance to consider this possibility is bewildering.
>> Does that show intent or a general lack of training or both? (rhetorically asked)
And it it were a blank round?
Numerous things don’t add up including the hasty cremation.
Everything lines up if the entire scene was staged.
OK You did empathize with Byrd. Don’t be so defensive about it.
I don’t see how “staging” the Babbitt murder would benefit either side in this situation, it certainly doesn’t benefit the deep state or the Democrats to stage such an event, what do they gain? Our side gains outrage I suppose, but most were already outraged about the election anyway.
But knowing that I am going down a rabbit hole like the 9-11 conspiracy diversions, where then is Ashli Babbitt today?
Glad I wasn’t in that position where I was defending the hallway in that building with adrenaline running while people were in the stairway smashing on the bullet proof window with a helmet until it finally gave in then an individual started climbing thru..........
Glad I wasn’t the capitol cop standing right by Ashli who did not find her a threat and was almost shot by that nimrod.

JUDICIAL WATCH
Medical examiner requested cremation of Babbitt’s body two days after Capitol breach, docs show
https://www.judicialwatch.org/in-the-news/just-the-news-babbitt/
Did he even do that?
And because it was under federal jurisdiction , there was no coroner’s inquest.
After all Babbit was just a white trash deplorable.
Nothing to see here.....move along now.
There will be hell to pay.
