For businesses, this bill serves to protect the business owner and employees from liability and actionable claims resulting from accommodating consumers per the non-discrimination requirements of this new law. In addition, this would remove businesses from the politicized conversation regarding masks and immunizations and leave public policy in the hands of lawmakers.
Private property rights should not be construed to suppose that business owners now have a right or a duty to regulate the healthcare of their consumers. When we consider securing liberty for all, we must also consider restricting liberty to some degree. This is the essence of law. In this case, we consider bodily autonomy and medical freedom to supersede the rights assumed by a property owner when considering securing liberty for all to enjoy. We would also argue that healthcare policy is outside of the competency of places of public accommodation.
