I think if he does that there will be a contingent election by the state legislators, and it will heavily favor Trump. Instead of putting the burden on pence to throw out votes he would alley-oop to SL. It would be a much stronger victory because it would come from congress too.

If they send it back to the state legislatures it would be a shoe in. The only reason they haven't decertified is because they aren't in session and those who are required to call a special session refuse to. So many SLs sent Pence letters asking to decertify.

Maybe Hollingsworth will come into you play, as you posited weeks ago.

Sending the slates back to the States to fix would be a great way out.

It is a punt, but buys time for more proof to be revealed in the proper venues.

And no one can fault Pence for doing so.

If Dementia Joe actually got 80 million votes, then Democrats should welcome any inquiry that establishes that fact.
