Brandon Bernard is set to become the latest federal inmate executed by President Donald Trump's administration—even though five of the surviving nine jurors who condemned him to death have changed their minds.
The 40-year-old is scheduled to die by lethal injection at the U.S. Penitentiary in Terre Haute, Indiana on Thursday.
Bernard, who is Black, was 18 when he was convicted over the 1999 kidnapping and murder of youth ministers Todd and Stacie Bagley at Fort Hood in Texas.
Bernard's co-defendant, Christopher Vialva, was executed for his role in the Bagleys' murder on September 22. Vialva was the first Black inmate put to death after the federal government resumed the death penalty earlier this year.
Bernard's attorneys have asked for his execution to be stayed, arguing that it will otherwise allow the federal government to evade review of its suppression of expert evidence that likely would have led the jury to spare his life.
"Expert evidence that Bernard occupied the gang's lowest rung would almost certainly have persuaded at least one juror to vote for life," the motion said.

“...Bernard, who is Black...”
So? Was he any less responsible for these two murders?
Why is the author trying to tell us by including skin color?
“Sadly, I suspect the jurors who have reversed their decision have been threatened into doing so.”
They might just be public schooled ignorant Hussein Heads who associate FraudCo with Fort Hood, and want to support him in every way possible, by any means necessary.
“Did this beast commit the murders?”
He didn’t actually commit the murder for certain. The guy who shot the couple after abducting them was executed in September. But Bernard set the car they were locked in (trunk) on fire. No where in the articles I have read said that they died from gunshot. This is an effort to destroy evidence and try to soften the act he was involved in by smearing the decision.
It seems strange that jurors are being used to try to do this when they made a recommendation years ago as a jury does not make the death decision, the judge does. Jury only recommends, not sentences.
The other problem I have here is they are trying to blame Trump for executions applied by the states. Out of the 29 states that still retain the death penalty, eight of them had executions in 2018. A total of 25 executions. Texas had the highest number of executions with a total of 13, all of which were men and none of them had anything to do with Trump. It just never ends does it?

Adios, MoFo!
Hamburger surprise for the inmates tonight!
Since we can’t get input/comment from youth ministers Todd and Stacie Bagley, then the execution should proceed as currently scheduled (it’s way, way overdue).
Just being a gang member is enough for me.
Whack him.
Trump is under no obligation to listen to the jurors. The guy’s age and race are irrelevant.
And the young couple he murdered was not.
What's the point?
Being black while murdering white people is somehow an excuse?
“Why does the writer spell black with a capital B?”
Is there a way to kill him as he killed the others? It would be neither cruel, nor unusual, because he did it to innocents.
Reminder: Christopher Newsom and Channon Christian murdered January 2007
The same reason white is lower caste?
I have 2 things to say about this.
1: The red wire is positive
2: The black wire is negative.
CC
And his skin color is relevant why?
“Bernard, who is Black”
Bernard is black, not Black.
Anyone who disagrees is not to be trusted.
Off with his head!
You were involved in the kidnapping and murder of 2 people.. I do t care if you were the gang leader or the newest recruit. You should be dead already not sitting in prison for 22 years
“I have 2 things to say about this.
1: The red wire is positive
2: The black wire is negative.”
No.
The red wire is positive
The Black wire is negative.
