Brandon Bernard to Be Executed Despite Five Jurors Urging Trump to Commute Sentence

Brandon Bernard is set to become the latest federal inmate executed by President Donald Trump's administration—even though five of the surviving nine jurors who condemned him to death have changed their minds.

The 40-year-old is scheduled to die by lethal injection at the U.S. Penitentiary in Terre Haute, Indiana on Thursday.

Bernard, who is Black, was 18 when he was convicted over the 1999 kidnapping and murder of youth ministers Todd and Stacie Bagley at Fort Hood in Texas.

Bernard's co-defendant, Christopher Vialva, was executed for his role in the Bagleys' murder on September 22. Vialva was the first Black inmate put to death after the federal government resumed the death penalty earlier this year.

Bernard's attorneys have asked for his execution to be stayed, arguing that it will otherwise allow the federal government to evade review of its suppression of expert evidence that likely would have led the jury to spare his life.

"Expert evidence that Bernard occupied the gang's lowest rung would almost certainly have persuaded at least one juror to vote for life," the motion said.

Sadly, I suspect the jurors who have reversed their decision have been threatened into doing so.

Who cares what the cucked former jurors think? Did this beast commit the murders? If so, it should have been exterminated like the cockroach it is years ago.

It was a pretty horrific crime, double homicide with no mitigating circumstances as I recall. Other than the normal liberal clap-trap about being 18 and a minority.

So he outlived a quarter of his jury despite the fact that he is on death row.

His life expectancy was probably tripled at least by his incarceration and lengthy appeal period so he he almost certainly lived longer than he would have as a street thug. Shoot him up and send him on his way. Satan will be waiting for him.

I don’t think they “falsely” convicted him.

Five Jurors changed their mind. Well first, you don’t get to change your mind as a Juror. Second, SEVEN didn’t change their mind.

Let ‘em try to get this creep off.

We shall see.

Why pay for his upkeep for another thirty or so years?

Defendant’s argument is I did not kill them as badly as the white guy that killed them. I guess the best response to that is, if we could, we would have executed the white guy twice and you only once. Since we can’t execute him twice does not mean we can’t execute you once. Have a good trip.
