The author thinks Barr wrote it to check Mueller & Rosenstein, then Trump appointed Barr to implement his own memo's view. But I don't think so for several reasons that I will explain.

As the article points out, Barr directed his memo at the theory proposed by "Mueller's team" that Trump violated § 1512(c)(2). Not Mueller, Mueller's team. It seems certain that Barr was tipped off to the arguments that Mueller's team were making almost a year ago. But why?

I think it was to give Mueller & Rosenstein ammunition so that if Mueller's team of Angry Democrats tried to push for an indictment before the 2018 election, it could be rejected. But to keep their powder dry while over investigations continued.

It seems pretty clear that the theory put forward by the Angry Dems on Mueller's team is ridiculous. That Barr is on solid legal ground & they just made shit up to try and get anything by interpreting the statute in a vague manner that was not supportable by any precedent.

But where does that leave us now? Remember Mueller's letter to Barr about the summaries? It is also said to be written by Mueller's team, not Mueller. Pushing Barr to release the summaries that pretend their theory on obstruction is valid. Result? Dems implode versus Barr.

The Dems are now insisting that Trump broke an obstruction of justice law that Mueller never ruled he broke. Just that his team constructed an unsupportable legal theory that this law applies in ways that it does not. Destroying evidence so it can't be used in a future proceeding

But Trump didn't destroy any evidence, in fact he handed over EVERYTHING, waived executive privilege, & did everything possible to provide witnesses. So he could not have violated that statute. It's why Barr said their argument was fatally flawed, but hasn't explained it to them!

But where does it leave the Democrats in Congress? Attempting to expose Trump for violating an obstruction law that he did not violate! What harm will come out of that? None! For Trump at least!

So again it seems like the Dems were set up for a fall in June 2018. Which leaves us with the question, how did AG Barr know then? Did his friend Mueller explain the theory is Angry Democrat staffers were baking up?

Did Mueller, Barr & Rosenstein neutralize this attack in June of 2018? Then wait until the OIG report was ready to let the Angry Dems try & spring their trap? With no idea that they were checkmated before they knew the game had begun!

I can’t imagine Mueller going along with this horrific smear of Barr as he and Barr have been friends for 30 years.

On the other hand, Mueller threw Barr a Hot Potato by making those comments about obstruction of justice in the report.

What Mueller did was to take a parting shot at the president because they couldn't pin collusion on him.

He smeared the president, muddied the water, and gave the democrats an opening to claim there was evidence of obstruction while at the same time setting Barr to take the heat.

If there was actionable obstruction he should have acted on it.
But of course there wasn't and isn't any actionable obstruction so he was out of line including those comments in the report.

To me it looks like he just could,'t resist giving the finger to the president on his way out the door.

I consider Judge Napolitano to be a friend so I write this with regret. An obstruction case where there is no proof of an underlying crime is questionable. If you add to it nothing actually obstructed, there’s no case. Judge reconsider your position. This is a Weismann.
