There’s an arrest recorded for him on my local PD’s website. The charge was “assault on a child under 12.”
Self defense! If he turned his back, they would have struck him. They hit him first and second, when he turned and pushed the girl away, she came back at him with full preparation to strike him(a third time). He beat her to the punch, literally.
You ask good questions. Here’s another question that should be asked as you contemplate a dangerous situation in a split second.
“Should I risk going to jail and ruining my life if I get involved?”
Exactly, I don’t want to open things up to some subjective weighting of if this was ok. At what point do you need to be “bigger and do nothing”? At what point does an age gap matter? Man vs. woman? Big woman vs. little man? Who will decide?
Looking at it again, I think excessive force is not applicable - his first response to her assaulting him was to push her away very assertively. That she decided to charge him with fists raised is her own stupid fault. ANYONE that is able to do damage, which this girl is big enough to do, should expect the VICTIM to punch back. They have every right to. I believe that as he only pushed her first, this was a measured response....hope he gets that across to a jury.

You keep saying that walking in public is not illegal. I would point out that walking in the middle of a BLM riot is not illegal either. It’s mighty stupid though, just like walking in the middle of a feral cat fight.

As for evading the question, here goes. The video shows the man was assaulted first. But so what? Stupid should hurt.
Why walk back into the mall? That’s a valid question. Certainly many on this thread would deem the man a coward if he walked away. But one thing is pretty clear now. I bet he wishes he had walked back into the mall.

I would suggest you create a tag line such as;
"If you're assaulted, so what, I don't care, just take it".
Outrageous, yes. Still a jury trial is possible for 6 month or less sentences under certain circumstances, say additional penalties increase the seriousness of the offense.
Also, as I read it, state laws can guarantee a jury trial even when the seriousness doesn’t meet federal standards. States cannot set a seriousness standard higher than the federal law however.

I wonder where some of these posters come from. I come from a rough area in south philly back in the 60s 70s 80s and the nj suburbs in the 90s on.
I raised my kids in Marlton nj in the 90s, 2000s, 2010s. So different from my philly roots.
I was raised and grew up in south philly with all the traditions and racial wars. We lost the racial/culture war but the traditions of those still there still stand in certain neighborhoods.
All the people wanting and celebrating the diversity, lmao. The good neighborhoods are in a tiny area now and growing smaller. And those good neighborhoods when I was growing up, were the bad neighborhoods...gentrification and all that, lol.
A group of teen girls, anywhere now, are a threat. I’d feel more safe confronted by a group of feral teen boys than girls.
Girls fight dirty. Always did. And they expect not to be hit back by males. And today’s society expects that also while claiming girls and boys are the same.
I’d have no problem hitting a teen or younger girl but I’m a woman. A male can’t do that for whatever reason.
Years ago I was threatened by a teen in our former neighborhood and he threatened my two elementary aged kids. Called the cops. Cop was not helpful and stated I was picking on the kid because he was black. So got my detective nephew in another town involved and finally got police help. I get that it’s all about who you know.
I had a baseball bat to that kid, literally, and told him he needed to look behind him because I would get back at him. That’s crazy? Why? He threatened my kids. He told my husband who tried to reason with him that I was crazy. Yeah, I’m crazy when you threaten my kids, lol. My husband told him, yeah she’ll kill you if you mess with our kids so don’t.
Years later, we and another family were stalked. Went to our local cops. They did nothing. We were threatened, our kids threatened to be raped, etc. They did nothing until I got my detective nephew involved. Then they finally investigated and got the perps. It’s all about who you know. I called the family, told them I knew what they were doing and if they followed through then I’d blow their brains out, kids or not.
People are weird. Weirder now with all the entitlement. Us working people, have had enough and the media no longer have hold over us.

In this particular case, if reports are correct and his wife and daughter were accosted, you betcha! All in.
Non family, would depend on the degree of injury threatened or received. If life or limb threatening, yes, I would risk jail to do what is right.
Self defense of one's self or another is just.
If it were me, and me and mine weren’t involved, I’d leave.

If someone was being assaulted, I’d probably intervene. Only because I’m armed.

I’d like to think I’d do the right thing but I’m not sure I would.
A few years ago, there was an incident at the Moorestown Mall. I was there with my two youngest. We were eating cinnabons and auntie anne’s pretzels, a fight broke out and I got up and directed my two little kids to run into the Sears store. They were frantic and I was frantic but the only on my mind was getting them out.Didn’t matter what was going on. All I cared about was getting my kids to safety.
My kids are adults now so different maybe. Then, not my monkeys, not my circus. The only thing that mattered were my kids.

And on that video it shows the man being the first one to lay hands on someone (probably the girl who pushed him back) as he spins someone out of the way at the 4-6 second mark. You have to watch carefully and maybe pause the video to see it. And the video starts with him yelling ‘break it up’ as though he was intervening in someone else’s fight. Not the time to do that if he was with any family members and consequently put them in harm’s way. He was either coming or going from the mall. Should have just kept going.
The ones stayed and helped, did a lot of explaining to the law, both in and out of court, ok in the end,justified.
The one I left, decades later, still bothers me.
I think so, too. Hate what I say, but don’t hate the truth, reality.
