I hope this is fake news. Another Souter or a Kennedy is exactly what I fear most in this.

I know very few liberal or conservative women who are anti gun. It is the liberal men that I know who are outspoken and view them as ‘icky’.

I hope this is not true. Hardiman seems to be a Kennedy type.

From various sources:

He fits the bill with regard to his pro-life stance and he is strong on the second amendment, but he is seen as a government friendly conservative like William Rehnquist and has sided with Big Brother on censorship issues. He is 51 and like the other two candidates would likely have influence for decades to come. He might be the most confirmable of the three, having been confirmed 95-0 on the appellate court with votes from Senate Minority Leader Chuck Schumer and Diane Feinstein.

Conservatives would have been fine with either Pryor or Gorsuch, but the fear was Trump would pick Hardiman, who was about as close to the center without falling into the left. Hardiman even served on the same court as Trump’s sister. The writing appeared to be on the wall, many believing Trump was about to reveal exactly why he couldn’t be trusted.

Now, some conservatives are expressing concern that Third Circuit Court of Appeals Judge Thomas Hardiman, widely believed to be one of Trump’s likely picks for the Supreme Court seat, could be Souter 2.0.

He concluded that the First Amendment doesn’t give citizens the right to videotape police officers.

He wrote an opinion allowing a gender stereotyping claim from a self-described “effeminate” gay man, concluding that he was “harassed because he did not conform to [his employer’s] vision of how a man should look, speak, and act.” He ruled in favor of African-American firefighters challenging a fire department’s residency requirement, on the grounds that it was a form of discrimination against black firefighters not living in the overwhelmingly white area served by the fire department. He noted that while only 3.4 percent of the population covered by the department is black, 0.62 percent of the firefighting force is, concluding, “minority workforce representation that low suggests discrimination.”

Finally, an influential measure of judicial ideology — the Judicial Common Space score — places Hardiman somewhere between John Roberts and Anthony Kennedy

I think you may have had it the other way round. What was the number one reason why conservatives voted for Donald Trump in 2016? Justice Scalia’s replacement in The SCOTUS. In fact one of the main reasons why Trump won was because Republicans were sure he’d nominate a conservative to replace Scalia.
Let’s say Trump nominates Barret, that puts pressure on the US Democratic Senators from North Dakota, West Virginia, Missouri, Indiana etc, all up for re-election in November, in states that Trump won by double digits. If these Senators vote against Barret, they lose in November and Trump gets Barret through anyway in January. I think Trump is in a very good position because the SCITUS vote will be just a few weeks before the November elections.

I think it’s going to be Kavanaugh and was always going to be Kavanaugh. I suspect Kennedy was assured of this before he announced his retirement, and everything since then has been for show.

For similar reasons, if the GOP holds on to the Senate, I bet Thomas will retire and be replaced with Jim Ho.
