I would say Flynn has a good chance for appeal, right?
No, he has waived the right to appeal. He needs to file a motion to withdraw his guilty plea.
Flynn is no doubt considering the withdrawal of his guilty plea.
The stench at the FBI and DOJ is getting rather unbearable.
Time to flush that toilet...
The routine they put a defendant through before a guilty plea is accepted in Federal Court is designed to avoid that problem including the possibility of an appeal.
Due to a Supreme Court ruling in Giglio v Untied States the case is totally tainted and should be thrown out with prejudice as Flynn and his lawyer were not notified that Strzok was let go due to his massive conflict of interest. It also means that Mueller and the others could be disbarred and prosecuted for withholding evidence.
Withdrawing a guilty plea is rare. However, I would say Trump has good reason to pardon Flynn.
