The terrifying and terrible prospect of Justice Kennedy retiring
Washington Post ^ | June 23, 2017 | Ruth Marcus

Posted on 06/23/2017 8:10:52 PM PDT by rdl6989

The end of the Supreme Court term looms, and with it the prospect — the terrifying prospect — of a retirement. Specifically, the retirement of Justice Anthony M. Kennedy, who will turn 81 next month and is the longest-serving current justice, named to the high court almost 30 years ago.

So if Kennedy is inclined to retire, it is hard to begrudge him that choice. But his departure would be terrible for the court and terrible for the country. It could not come at a worse time. Any court vacancy these days, under a president of either party, triggers a battle between liberal and conservative forces. Kennedy’s retirement would unleash nomination Armageddon, given the feral political environment and the pivotal role he plays on the closely divided court.

When Reagan nominated Sandra Day O’Connor, he did not have a liberal Senate. It was a monumental mistake.

I would not be as optimistic. First, President Trump has to appoint an originalist. Among the judges in Donald Trump’s famous list of potential candidates, some are originalists, others are not. For example, Judge Hardiman, who is said to have been a finalist to replace Justice Scalia, is not.

Currently, there are only two originalists there: Justice Thomas and - hopefully - Justice Gorsuch. Justice Alito is reliable most of the time, but from what I have read he is not an originalist methodologically (Chief Justice Rehnquist was similar). We must not forget that the method is as important as the result if we want to prevent the Supreme Court from becoming a purely political body. Chief Justice Roberts is less reliable than Justice Alito and definitely not an originalist.

As well as the concept that Treaty Tribes have Rights which all others do not.

“... All others have mere privileges that can be revoked at any given time - SCOTUS.

We will keep the champagne on ice—for now.

We always celebrate when something happens that the Washington Compost says is “terrible for the country”. :-)

Another nice piece from the WAPo Stormfront. The muzzie bastard put a dyke and the la Raza klan member on the court and now a lib traitor might be replaced with a pro-American patriot.

If Kennedy retires, D.C. Should be avoided as surely the liberal nut jobs will be jumping out windows or crapping their britches.

I must ask, since when is the Washington Post considered, ‘news’?

She wanted to hang on to insure that her replacement was picked by “the first woman president”.

Can you provide a source for that?

It “seems obvious upon casual observation” to me. Many others have come to the same conclusion.

Here is a strong hint in a Slate article.
