FULL TITLE: Homeowner who found a 'naked' teacher's aide taking a SHOWER in his house, left to get his gun and then returned to shoot the 'intruder' dead through the bath curtain is charged with murder
An intruder who was shot dead by a homeowner after breaking in and using the shower has been identified as a 31-year-old teacher's aide.
Nathaniel Joseph Rosa was killed on Saturday morning inside the bathroom of a property in Belfair, Washington.
The man who owns the property has been charged with murder.
Police said the homeowner, who has not been named, called 911 shortly after 8am on Saturday and told the dispatcher he had shot an intruder.

He should be charged with murder. He LEFT to get a gun, meaning he was under no imminent threat. He could have called the cops and waited outside.
Granted the guy had no business taking a shower in someone else's house, however the shooter was in no danger. This is clear by him being able to leave and then return. When he left he should have just secured his weapon and called the police.
IOW once he broke contact he was out of any danger.

If this is the incident I am thinking of, he found the guy in the shower and LEFT the house to go to another house nearby to retrieve his gun. Then he CAME BACK to the house and shot the guy in the shower. Then he called 911 to report it.
That is pretty clearly murder to me.

Absolutely. No reason to shoot a naked man in the shower.
However, his lawyer could establish a defense that he was attacked by a friendly weapon.
Of course he was charged. You have the right to self defense, and you have the right to use lethal force in self defense if faced with an imminent threat of being killed or seriously injured. That does not apply here. Once the shooter left the house, there was no imminent threat. He should have called the police to deal with the intruder.
These type of incidents and those who defend the shooter in them just give lefties ammunition for their gun control argument. This one’s a no-brainer. You don’t have the right to shoot someone simply for tresspassing; there must be an actual threat.
It was an empty house where no one lived. Slight overreaction. A call to the police for trespass would have sufficed. Death does not.

I agree that he should not have shot the guy. I would not vote for Murder 1 as a jury member, but a lesser charge is justified.
I respectfully disagree. A naked man that you don’t know in your home is a clear danger. Not just to a female but to males these days.
Then again, had it been me I would have not only called 911 I would have ordered him out side at gunpoint for all the neighbors to see. No towel, just his birthday suit.
This is one case where the property owner had ample opportunity and plenty of time to let the police handle the situation.
He obviously was in no immediate danger, had time go to his other house next door to retrieve a gun.
I got plenty of guns for home defense, but I believe it is immoral to take a mans life when he poses no immediate threat.
Obviously, you can’t tell what a home invader is “packing” if he is behind the shower curtain.

You don’t get it. Am not harping about the fact he returned and shot. It’s that many of you don’t see a naked man as a danger. In this day and age you should. More so of that man is someone you don’t know and is in your house. Yes he should have called 911 but that does not man that naked man was not a danger just because he was clothing challenged at the time. He was more dangerous because of.
