I agree that he should not have shot the guy. I would not vote for Murder 1 as a jury member, but a lesser charge is justified.

I would not vote for Murder 1 as a jury member, but a lesser charge is justified.Why not? Ample evidence of intent on the shooter's part. I'm sure the guy's attorneys will negotiate a plea bargain to get murder one off the table. His attorneys will not want this to go to trial.
