2 Iraqis file lawsuit after being detained in NY due to travel ban

Washington (CNN)Lawyers for two Iraqis who had been granted visas to enter the US have filed a lawsuit against President Donald Trump and the US government after they were detained when they arrived in New York Friday.

The lawsuit could represent the first legal challenge to Trump's controversial executive order, which indefinitely suspends admissions for Syrian refugees and limits the flow of other refugees into the United States by instituting what the President has called "extreme vetting" of immigrants. Trump's order also said Iraqi citizens, as well as people from six other Muslim-majority nations, cannot enter the US for 90 days, and suspends the US Refugee Admissions Program for 120 days until it is reinstated "only for nationals of countries for whom" members of Trump's Cabinet deem can be properly vetted. According to court papers, both men legally were allowed to come into the US but were detained in accordance with Trump's move to ban travel from several Muslim-majority nations. The lawyers for the two men called for a hearing because they maintain the detention of people with valid visas is illegal.

HLS may have to take any airline, foreign or domestic, to court that issues tickets to foreign nationals on the no fly list.

Pulling their license to fly their planes into our country on a case by case basis would go a long way towards convincing them to stay out of politics and obey the law.

Section 212(f) of the Immigration and Nationality Act of 1952 states: “Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.”

Last six Presidents have used this multiple times each. Lawsuits will be going nowhere.

How are they going to appear in court to testify if they can’t get in the country?

Only defendants can withhold testimony.

I don’t see a prob w/a lawsuit.

Oh, no! One has been held 14 hours!!! The hugh manatee! Did CNN bother asking if the next flight back to where he came from was 14 hours or was the lawyer the one detaining him here? Vet them thoroughly and ship them back from where they came.

Why were they trying to slip in under the wire?
