Man was caught on video delivering one fatal blow in a checkout line. Now he’s paying

One backhand blow. One death. Seven years in prison.

That’s the punishment for Roger Perry, the drifter who fatally decked Miami Beach’s Mohammed Hussein, a crime that was caught on video and that shocked South Florida.

Back in December, Perry was standing in line at the M&L Food Market, 7446 Collins Ave., when Hussein approached him to tell him that he was in the wrong checkout lane. They exchanged some heated words and Perry backhanded Hussein, 58.

Hussein, a father of two, fell to the ground and hit his head, causing severe brain trauma. Hussein was rushed to Ryder Trauma Center, where he lingered in a coma for two weeks before dying.

Once they check 10 items, they inform the customer that they need to go to the back of the Express Lane to check the rest of their items.

I've thought about a 20% surcharge on the most expensive items if you break the limit. Automatically computed regardless of which item scanned first or last. One item over limit? 20% surcharge on the single most expensive item purchased. 2 over? Next most expensive item, etc...

Post it. Store policy. Proceeds go to charity.

If you have two apples in a single bag, is that one item or two items?

One item, same as a 6-pack. Most fruit is by weight anyway. Some things ring up individually, but if it's in one bag, it's a non-issue.

That’s one moral of this story. I’m not condoning the excessive (in this case, deadly) use of force, but there is no reason to get in someone’s face over a grocery line violation. Let the cashier or manager handle it.

This story is all too common. When I was young, barely in high school, I read about a road rage incident near me where two middle-aged guys got into a minor spat and one punched the other resulting in the victim hitting his head and dying. The puncher was a professional guy, never in trouble with the law, with a wife and children. It left an indelible impression on me. I avoid confrontation. Nothing good can come from it. Don't put yourself in a bad situation and remove yourself from the bad situation when you find yourself in it.

When I was teen, I wish my parents had made me memorize The Art of Worldly Wisdom by the 17th-century Spanish Jesuit, Baltasar Gracian, S.J. It is the antithesis of Machiavelli's The Prince. Sort of like The Art of War for Christians, sans the self-abasing piety (chump) and warm fuzzy do-gooderism that affects most of modern Christian literature. Medieval literature like Gracian is very manly and warrior-like. Even cunning. Below are 178-210 of 350 aphorisms (NB: Gracian gives a half-page commentary on each aphorism. I would suggest the modern Christopher Maurer translation):

Trust your heart.

Reserve is the seal of talent.

Never govern yourself by what your enemy ought to do.

Don’t lie, but don’t tell the whole truth.

Show everyone a bit of daring: an important sort of prudence.

Don’t hold on to anything too firmly.

Don’t stand on ceremony.

Don’t risk your reputation on one roll of the dice.

Know when something is a defect.

When something pleases others, do it yourself.

When it is odious, have someone else do it.

Find something to praise.

Utilize other people’s privations.

Find consolation in everything.

Don’t take payment in politeness.

A peaceable person is a long-lived one. Beware of someone who pretends to put your interest before his own.

Be realistic about yourself and your own affairs.

Know how to appreciate.

Know your lucky star.

Never stumble over fools.

Know how to transplant yourself.

Be prudent when you try to win esteem.

Have something to hope for.

Fools are all those who look like fools, and half of those who do not.

Words and deeds make a perfect man.

Or at least be prepared to dodge and retaliate.

I was waiting on a carry-out pizza and these people of color, a married couple (both tall and sturdy) and a man with his kid got into an argument. The guy with his kid left muttering something about disrespecting him in front of his boy.

I turned to the couple and said, “If he comes back in here with a Glock, I’m getting behind you two.”

My gawd, one punch and he’s dead. Fists are deadly and justifies shooting back in defense.

He died from smashing his head on the floor. Had they been on a beach the victim would likely have been fine. Not saying people shouldn't take violence even from unarmed people seriously. Defend yourselves! Just saying this was a freak situation, people are not so fragile that a punch in the jaw is likely to kill them as it seems some on this thread are saying.

That’s exactly what was going through my mind. But both members of the couple were thick enough that they would have stopped anything up to and including 9mm.

Note here: a single blow from the hand constitutes ‘deadly force’ in point of fact, and reciprocal force is justified. That old ‘sock on the jaw’ or ‘punch in the beezus’ from vintage films can kill you.

I remember watching westerns and crime dramas and old movies as a kid when the bad guys who were planning a robbery would resolve to "knock out the guards" so as to not get the death penalty if they were caught. I'm sure I was not alone in thinking that hitting a guy on the head with a gun would merely knock him out and not kill him.

The victim in this case seems to have died from hitting his head on the floor rather than from the blow itself.
