Sen. Durbin: ‘I Paid $1.51 A Gallon’ – ‘We’re Missing An Opportunity’ To Hike Gas Tax

Sen. Dick Durbin (D-Ill.) says, current gas prices have gone down and the government is "missing an opportunity" to increase the gas tax.

At a press conference in Chicago on Friday Durbin said, "Two weeks ago I paid $1.51 a gallon for gasoline in downstate Illinois. Clearly, the price of gasoline has gone down dramatically, as has the price of a barrel of oil -- which I think is below $30."

"I think we're missing an opportunity here -- a 5-cent increase in the federal gas tax can really fund an infrastructure program that can help create new jobs in this economy and help businesses. Now is the time to do it." ...

At the current price of gas, about $1.00 of the price is taxes in California.

39.5 cents a gallon state excise tax
18.5 cents a gallon federal excise tax
10 cents a gallon cap and trade tax
and 7.5% to 10% sales tax on entire sale (local and state tax).

With all due respect to Sen. Durbin, low-information Durbin is another excellent example why the ill-conceived 17th Amendment should never have been ratified.

Durbin evidently does not understand that a previous generation of state sovereignty-respecting justices had clarified that Congress is prohibited from appropriating taxes in the name of state power issues, essentially any issue that Congress cannot justify under its constitutional Article I, Section 8-limited powers.

”Congress is not empowered to tax for those purposes which are within the exclusive province of the States.” - Justice John Marshall, Gibbons v. Ogden, 1824.

Based on the Courts statement above, here is a rough approximation of how much taxpayers should be paying Congress annually to perform its Section 8-limited power duties.

Given that the plurality of clauses in Section 8 deal with defense, and given that the Department of Defense budget for 2015 was $500+ billion, I will generously round up the $500+ billion figure to $1 trillion (but probably much less) as the annual price tag of the federal government to the taxpayers.

In other words, the corrupt media, including Obama guard dog Fx Noise, should not be reporting multi-trillion dollar annual federal budgets without mentioning the Supreme Courts clarification of Congresss limited power to appropriate taxes in budget discussions.

Getting back to Sen. Durbin and his suggested gas tax, Durbin is clearly clueless that the corrupt feds are currently raising several time more revenue than reasonably allowed by the Constitution.

Remember in November !

When patriots elect Trump, Cruz, or whatever conservative they elect, they need to also elect a new, state sovereignty-respecting Congress that will not only work within its Section 8-limited powers to support the new president, but also protect the states from unconstitutional federal government overreach.

Also, consider that such a Congress would probably be willing to fire state sovereignty-ignoring activist justices.
