A Queens woman died after allegedly getting trapped in a local Burger King restroom, and now, her family has sued the fast food chain.
As CBS2âs Ilana Gold reported, Shirley McCarthyâs family has also detailed what happened during her final moments at the Burger King on 82nd Street in Jackson Heights.
The incident happened on Sept. 27. McCarthyâs boyfriend, Ricardo Knox, still struggles to cope.
âI wake up every morning and it feels like Iâm in a dream,â Knox said. âShirley didnât deserve to die in that bathroom. She wanted to live like everybody else. God bless her soul.â
Knox said McCarthy, 47, didnât feel well, so she went into the single-stall restroom and locked the door. Moments later, she had the symptoms of a seizure and fell on the bathroom floor.
McCarthy could not reach the door handle, so she started screaming for help.

She probably went into the restroom to have a hit of her favorite stuff and overdosed.
Family also claims 'doctors' say she likely died as a result of lack of oxygen to the brain.
If I were BK, I'd be on the judge's doorstep demanding he order an unbiased autopsy. I'd be looking for drugs.
Another news report says she claimed she was having a seizure, but she was able to communicate that she could not open the door that she locked from the inside. The firefighters broke down the door "within minutes" but the lawyers and the families are saying the restaurant is at fault.
That was my guess.
What is BK’s culpability here - their door handles aren’t close enough to the ground?
She wasn’t “trapped”, she had a seizure with no one around to help and being unable to open the stall door is irrelevant.
The same could have happened in her own bathroom or even in her front yard.
So now every public restroom has to had a door handle four inches off the floor?
On a serious note, one safety feature I’ve seen in New England as a direct result of The Station fire in Rhode Island was lighted exit signs at floor level (instead of just hanging from the ceiling). The fire in that club (which was a small building with low ceilings) caused smoke that obscured the regular exit signs, and many people couldn’t find them in the confusion.

Regardless of what killed her. She went in the stall and locked it. How did the proper functioning of the door cause her death. A swing and miss in the lawsuit sweepstakes!
Unfortunately, you can't sue your front yard. ;-)
What does someone have to do to “deserve” to die in a Burger King bathroom?
My guess is the family knows it won’t win. They’re depending on a “go-away” settlement from BK. Unfortunately, it often makes business sense from a financial perspective.

When I was a kid a guy just outside of town had a heart attack and died in the hammock he napped in every day.
For nearly 3 days people drove by and waved before somebody stopped to talk to him about hiring him to fly somewhere. (He was a pilot)
