When the Supreme Court announced its decision Wednesday on whether a fisherman should be charged under Wall Street regulatory laws,
Justice Elena Kagan decided to include an unusual judicial argument: Dr. Seuss.
In 2007 in Florida, law enforcement officials confronted fisherman John Yates, saying he had caught several red groupers that were too small. Mr. Yates then tossed the fish overboard. But he was charged under the Sarbanes-Oxley Act, which sought to punish the destruction of physical evidence in wake of the Enron scandal where accountants shredded thousands of documents.
In a 5-4 decision announced Wednesday, the Supreme Court ruled that the law was meant to apply only to records or information documents.
But in her dissent, Justice Kagan argued that fish should be included in the tangible object category of evidence the law describes.
A fish is, of course, a discrete thing that possesses physical form, she wrote. See generally Dr. Seuss, One Fish Two Fish Red Fish Blue Fish (1960).

FIGURES
The fact that even 4 people voted they way they did, indicates that you can’t fix stupid.
Now Kagan is hitting the sauce too? What is going on at the SC?
It’s snowing here.
A prime example Affirmative Action at its worst.
Kagan is clearly no genius. She’s known as a rat hack. Just another example.
“law enforcement officials confronted fisherman John Yates, saying he had caught several red groupers that were too small”...The fact that catching some fish that are too small is a crime is stupid to begin with.
Next week she will undoubtedly vote for the exile to Siberia or the massacre by starvation of America's independent farmers, just like her famous relative.
I am not a fisherman, but I thought that when you catch a fish that is too small, that you are supposed to throw them back...
She was trying to be witty I’m sure but I’m not really sure how the Suess quote pertains to the point she was making.... other than the fact that she has the ability to quote first grade reading material.
Not when they breed...
shouldn’t they be citing the Constitution and stuff, or am I just too old-fashion??
The “Wise Latina”. lol
Not when they breed...
Not when they breed...
I submit that the Dr. Seuss argument should be applied to repeal Roe vs Wade.
“A person is a person, no matter how small.”
from “Horton hears a Whoo”
Yep. In a sane world, virtually all SCOTUS decisions would be unanimous.
“In a 5-4 decision, Supreme court declares sun sets in the west.”
With the government putting its fingers into everything, I am reminded of something I read once, about the Fall of the Roman Empire.
The fall of the Roman Empire was not a disaster for EVERYONE. Perhaps for urban dwelling ne’er-do-wells dependent on “bread and circuses” but a lot of more rural people who produced food and were heavily taxed did better when the boot was removed from their neck.
Perhaps we shouldn’t fear implosion...
Her intellect indicates that she is nothing more than a hat rack.
