Woman gets fired without pay after telling her boss she has cancer
Carol Jumper, of Hopewell Township, Pa., received a handwritten letter of her termination from her boss, Dr. George Visnich Jr., shortly after she was diagnosed with cancer. Her family and friends are outraged but the doctor's attorney claimed he did a 'humanitarian thing.'

Health insurance is not mentioned.
Nope. He’ll be sued into the poorhouse.
she would have been eligible for social security disability and may, in fact, still be. I went through this with my mother a few years ago. She had to retire early from the post office. There was absolutely no way to fight her cancer and work full time and in the end, as is the case in so many of these battles, she lost after 18 months anyways. As rough as it sounds, I’m not sure I can fault Dr. Visnich for this. Carol is in a fight for her life. She can collect unemployment benefits while she puts her affairs in order and wages her battle as she sees fit.
Yep, it appears he was attempting to use UE insurance to act as a form of sick leave for her.
That’ll teach him.
I don't think so. The employer has the right to terminate employment without cause.
..............except if it violates the American Disability Act.
I’m not sure having cancer qualifies as a disability.
So she wasn’t fired as the title indicates.
Interesting point. Getting sick with a disease that is curable is a disability? I know mental disease & addiction are considered disabilities, now cancer?
Sounds like he is committing unemployment insurance fraud to me.
She could no longer physically do the job as required, and if her job didn’t cause her cancer then I am afraid the guy can probably do whatever he wants and should be able to.
My ex-wife had this same situation arise at her insurance office. They procrastinated about firing a lazy woman who arrived late, left early, took long lunches and didn’t work very hard. One day she announced that she had ovarian cancer, I believe it was. Until she was in complete remission they had to keep her on.
It can. My bride’s cousin caught cancer while self employed.
it might... being an alcoholic or drug addict qualifies...
I've dealt a lot with doctors professionally and some can be real a-holes.
Yep. “Able and available” is the standard in all 50 states and the territories the last time I checked and I worked at several state unemployment offices for almost two decades.
Under ada he will be asked if he could make any accommodations.
I’m with you, but I managed under ADA requirements.
Fraud would be paying her under the table.
Depends on the state though, here in Florida you can be fired for any reason. Including the boss had a bad day or he needed your salary to make his boat payment.
Is anybody ever fired WITH pay?
