What began as a simple traffic stop ended in a humiliating and nightmarish ordeal for a New Mexico man. It wont come as a surprise to most people why the man has now filed a federal civil rights lawsuit.
The incident began on Jan. 2 as David Eckert was leaving the local Walmart in Deming, N.M. He reportedly failed to make a complete stop at a stop sign, prompting police to pull him over.
The officers asked him to step out of the vehicle and claim the man appeared to be clenching his buttocks, Eckerts attorney, Shannon Kennedy, told TheBlaze. It is unclear why police removed him from the vehicle in the first place. However, because the cops believed he was clenching his buttocks, they took it as reason to suspect him of hiding narcotics in his anal cavity. Police officers detained Eckert while they sought a search warrant for an anal cavity search.
What is so strange about this case is they held him with no evidence, Kennedy said. They seized him to collect evidence, to go on a fishing expedition on someones body.
Upon securing the warrant, Deming police officers took the man to an emergency room, but hit their first snag when a doctor refused to perform the anal cavity search because he believed it to be unethical.
So police tried again at the Gila Regional Medical Center in Silver City, N.M., where doctors agreed to the search.
KOB-TV outlined the disturbing series of events that occurred next, details confirmed by medical records and official documents provided to TheBlaze by Eckerts attorney:
1. Eckerts abdominal area was X-rayed; no narcotics were found.
2. Doctors then performed an exam of Eckerts anus with their fingers; no narcotics were found.

I hope he gets $10 million from these idiots and serve as a warning to other idiots.
The scary part is there are some folks right here on Free Republic that would find this OK since it’s part of the war on drugs and all.

It will take years, and he will be a rich man. This is a nightmare gone out of control.
In ancient Rome it was illegal to shackle a citizen for any reason.
Of course being a citizen meant a lot more back then than it does in today’s America.
Now... this is when you criticize the police.
The officers involved, their immediate supervisor, the Police Chief, the judge that granted the warrant, the physicians that carried out the illegal activity, and the administration of the medical facility.
I wouldn’t want to be any of these entities. Every single one of them should have put an end to this immediately.
Just because two officers don’t have a lick of sense, it’s no cause for all of these people to join in lock step.
Good luck Mr. Eckert. What you took may wind up saving all the rest of us a similar outcome.

We can all sit here and realize this is nuts. The scary thing is how many people went along with this. A couple cops, at least one supervisor, a judge, maybe a DA, plus the doctors and staff. They all chewed on the facts of this and said "Yeah, get out the scope!"
Deming is close to the border, so there may have been something going on that prompted this.
That said, it’s insane. Basically there’s no justification for any of this. We can take you prisoner, knock you out and operate on you, just on suspicion?
Think he just rang the gong on a million dollar payday.
That should pretty much bankrupt Deming. It’s a tiny, dusty place.
Unfortunately it will be the taxpayers who pay for this fiasco. The only way this jerks would pay for this conduct would be if someone took them out.

They were on a mission to prove themselves right after it looked like a false arrest.
Once maybe, but eight times! When the first doctor refused to go along it should have taught the police something, but it sounds like they were just desperate to get into the anal cavity.
