Or NOT??? This guy obviously through this through and made it a possible point of ambivalence.
If the witness can’t discern between the two, positive identification is impossible! Any lawyer worth his salt could get that ID tossed on the indeterminacy!
(this might be extreme sarcasm but, as in at least 2 stories I have read today, closer to reality than any of us like...)
