Man ordered to remove 72-ft boat from yard

NEWPORT BEACH, Calif., A California man who has spent the past six years restoring a 72-foot ship in his yard said the city is ordering him to get rid of the boat.

Dennis Holland, who has been restoring the Shawnee, a 1916 ketch, at his Newport Beach home, said city officials obtained a court injunction giving him until April 30 to get rid of the vessel, the Los Angeles Times reported Monday.

Deputy City Attorney Kyle Rowen said Holland faces fines of up to $1,000 per day or possible jail time if he does not comply with the injunction, which was issued Thursday by Superior Court Judge Gregory Munoz.

Holland is accused of not abiding by an ordinance requiring him to obtain a permit. He said officials would not grant him a permit because he could not give them an estimated date of completion.

"Mr. Holland has been in violation of city laws for many years and has had ample opportunity to move the boat to a suitable location," City Attorney Aaron Harp wrote in an email Friday. "The city is hopeful that Mr. Holland will comply with the court order and move the boat to a suitable location that is consistent with applicable laws."

Holland said the ordinance he is accused of violating was passed in 2009 and he did not break any laws when he originally began the project.

"I can't move the boat," Holland said Friday. "The city's going to have to come in and destroy it. I don't have the heart to."

This guy has a familiarity with this boat going back to the 50s, and bought the boat when he heard the city was going to scrap her.

He also has cancer and will likely not see the completion of his project - he intends for his son to finish it.

Bureaucracies are the same all over - real bottom feeders.

Because when he started it, it wasn't against any ordinances?

Some projects can't be moved. I have had several project cars that once they are up on jacks and the wheels are off, they don't move until I'm done with them.

I’d help him too, but after 6 years and him refusing to provide a timeline it looks more like an eyesore.

When a neighbor effects the enjoyment of my property I take offense. If I move in next to a shooting range its my bad. If they move a giant ugly ass boat in then its theirs.

That’s pretty cool. I might consider it a neighborhood attraction, although there is the noise issue. How long is it going to take him to finish? Someone in town took six years to build a 3500 sq ft house all by himself.

Holland’s house looks like an upside down boat, with a wheelhouse perched on the hull.

Do you live next to him? If not, then you really don't have much of a complaint here...

Yeah, I can see that piece of you-know-what lowering the sales prices of homes in the area.
Unless this guy wants to pay the differences in the tens of thousands each one of these homes would lose, I would suggest he move it pronto.

It is his property. Where do you get the rights to claim anything about it? Maybe he doesn’t like the color of your house or that you BBQ outside and should demand you change those things? Maybe he thinks you have a cheap car and you should get a better looking one.

But if the hull is sound, it can be moved ... just as if it’s finished. That said, my point was that if it can be moved when completed, why not now?

But don’t misunderstand me ... I do NOT agree with the city on forcing this move. An ordinance can not be retroactive.

That would be an excellent estimation. With a wood boat when you get done at one end it's time to go back to the other and start again.
