Anna Nicole Smith has died according to ABC News

Anna Nicole Smith collapsed in her hotel room at the Hard Rock Cafe and Casino in Hollywood, Fla., and was rushed to a hospital on Thursday. A Hollywood, Fla., fire department spokesman told MSNBC TV that the actress was unresponsive when the rescue unit arrived on the scene.

Sources confirmed to Access Hollywood that Smith was transported to Memorial Regional Hospital shortly after 2 p.m. EST on Thursday. Access Hollywood also is reporting that Smith was intubated at the scene.

Officials told the Miami Herald, "it does not look good."

Well, he was named by her in the will as executor and in control of the trust.

Not sure being the father is going to be an issue. He will still control the money....if the courts rule that way.

Ah, you saw it differently from the way I was interpreting it. No inter vivos trust. I read it that there was already one in place and she was probably living off of it - and it was in place specifically in case she did get any awards from the Marshall estate - it would all be in Daniel's name and only his name.

Is that "toxic waste" part something CA makes them put in, or is it more in reference to any Marshall (Koch) properties she may have been awarded down the line?

There are tho....the minor child. Even tho the will said no future children....you cannot by law exclude a minor child from a will.

Judge Napolitano was just on again, and he said it's 'possible' that Anna's mother could inherit. He said that Florida law will not allow a baby to be disinherited, so she will receive something. HKS will not inherit, but he will receive substantial money from being the executor if the money comes through from Marshall. The judge says that HKS definitely has the right to bury her since he's the executor.
