Anna Nicole Smith collapsed in her hotel room at the Hard Rock Cafe and Casino in Hollywood, Fla., and was rushed to a hospital on Thursday. A Hollywood, Fla., fire department spokesman told MSNBC TV that the actress was unresponsive when the rescue unit arrived on the scene.
Sources confirmed to Access Hollywood that Smith was transported to Memorial Regional Hospital shortly after 2 p.m. EST on Thursday. Access Hollywood also is reporting that Smith was intubated at the scene.
Officials told the Miami Herald, "it does not look good."
I wonder if HKS floated that one.
Then why did Stern put that in the will?
CTV guy also said Daniel doesn't exist in terms of the will since his death preceded ANS.
There is no way it would go to California if there is some kind of heir. Let us know if he says the basis for his opinion.
It goes to a trust that he controls, per the will.
A minor child cannot be written out of the will....so even tho she didn't put Dannielyn in or excludes future children...sounds like that will be struck down. You cannot exclude minor children, from what we are googling.
So individuals claiming to be her offspring couldn't surface after her death.
So, it sounds like the will will be contested by HKS, and likely be successful based on inability to exclude unborn or minor children. He then is executor of will and controls the trust for Dannielynn.
Okay.
And reaffirms my reasoning about why Stern won't give up the baby.
Howard doesn't WANT the baby...He want's the baby's RIGHTS that aren't covered by his power of attorney. Any monies that he's making off of photos etc should be confiscated.
Insurance: He may walk away in the end with nothing but a couple of VERY large insurance policies (which aren't public record) and Anna's Swiss Bank Account (or offshore) and return to Ca.
Of course, if he's not the father, he won't have legal standing in a court of law.
This is gross negligence on HKS part, and that's may be ONE reason he is going to recuse him as executor.
Precisely!
"Anna Nicole Smith's Will is Revealed"
From Susan Candiotti...CNN
"Clouding an already murky legal scenario, some language in the will seems to exclude any of Smith's future spouses or children.
Smith's heir or heirs stand to inherit a stake in her longstanding claim to the fortune of her late husband, Texas oil baron J. Howard Marshall II.
As executor, Stern is authorized set up and oversee a trust on behalf of Smith's beneficiaries, and to make investments on its behalf.
The document could be crucial to giving Stern the legal standing to determine Smith's final resting place."

I don't understand that, either. Only men do that!
The CTV guest, who doesn't have the entire will, is saying since Daniel predeceased ANS, it's as if he never existed. And, it's just semantics or some such that ANS excluded any future children.
So....this guy is saying, actually, that words in a will don't really mean what they say.....head spinning, oh my!
(Hi, Rheos' hubby) :-)
Well, Judge Nappy has changed his mind; now he says the MOTHER is the lucky winner!
>>>Then why did Stern put that in the will?>>>
Maybe he KNEW that and let the will issue stay as it was because after Daniel is out of the way, he 'as the baby's father' could sue through probate.
That is ONLY if a dead child can be considered an heir in California or the Bahamas. Not sure which jurisidiction prevails and Daniel did not have a will. Have they throughly gone through his things?
From your experience, a dead child did inherit.
I don't know if that is true in all jurisdictions.
A trust can outlive a child but it looks like she didn't form one while he was still alive.
