The Durham cab driver who has surfaced as an alibi witness in the Duke lacrosse rape case today was found not guilty of a 3-year-old shoplifting charge.
Moezeldin Elmostafa is expected to provide an alibi for Reade Seligmann, one of three Duke lacrosse players indicted in the rape case, because he gave Seligmann a ride after the party that led to the rape allegations.
After authorities learned of Elmostafa's potential role in the rape case, they found an unserved warrant naming him in a 2003 shoplifting case at a Hechts department store at Northgate Mall in Durham. A security officer for the store testified today in district court that he saw a woman steal handbags from the store and then jump into Elmostafas cab, which sped away.
The security officer testified that the cab pulled away even before the woman had closed to the door. A store surveillance tape, played in court, appeared to show that the door closed first.
Defense lawyers in the lacrosse rape case have said that Elmostafa was charged because he is a favorable witness to the defense. Loflin put one of the lacrosse investigators on the witness stand this morning and produced typed notes from the lacrosse case that show District Attorney Mike Nifong wanted to be informed when Elmostafa was arrested.
Assistant District Attorney Ashley Cannon told the judge the shoplifting case has nothing to do with the rape case.

But - how can they come to that conclusion unless they know what the hair was tested for?

Her boyfriend is Matt Murchison - they lived together for a time. He was determined by the court to be a habitual offender - for driving while under the influence multiple times. He spent time in Prison. He got out under the same drug testing rules and is still her boyfriend when released.
Was the flexeril (or prescription drugs) and alcohol developed in order to beat the drug testing program they participate in?

So how did our mysterious headline writer come to the conclusion that the tests showed "accuser was free of controlled substances"?
It did no such thing.
I don't think it is a controlled substance.
It is apparently not even illegal to have it without a prescription.
I can't find it on the list of controlled substances.

Flexeril is not a controlled substance, but it does require a prescription.
That song along with "Signs", "Summertime Blues" and a couple others always flash me back to how much of a US v. THEM (the man) mentality there was during that time.
It's very painful to see those times returning.... Maybe they never really left...
Yes, but has anyone seen the toxicology report. Without it aren't we speculating.
Check the online pharmacies. See if you can buy it over the internet with a short questionaire. The online pharmacies have a doctor that reviews the questionaire and signs off on it.

I don't know that it's really such a bad thing. Part of our culture of being Americans is suspicion of "The Man." King George was our forefather's version of him. I think Americans have a very deep inbred view of justice and freedom. It's who we are...
