Duke Lax News - Mgean Kendall (no Link)
Foxnews
Posted on 06/04/2006 12:41:52 PM PDT by Perdogg
Megan Kendall says defenses sources are saying that CGM had sex with the driver the night of the alledged rape.
She also said that the prosecuter claims to have "good news" for their case. We have heard that before.
If anyone gets additional information on this, please provide links.
Thanks

Mmmm. Didn't Taylor pick her up from the hospital & take her home?(or did I dream that?) I can't figure out who picked her up. I thought she claimed her 'boyfriend', then Taylor says he didn't know her very well (even though he advised her what to wear that night and drove her there), then DNA comes back belonging to the 'boyfriend' and now they are saying she had sex with Taylor who didn't know her very well instead of the 'boyfriend', or are they one in the same??
I'm confused.

Yes, very interesting.
Nifong's case is falling apart as we speak.

Does anyone know where to find the timeline? I'm looking for when the players were told that the stripper accused them of rape.

She also said that the prosecuter claims to have "good news" for their case. We have heard that before. I've heard the the "Good News" is that the driver says the "dancer" was in no way impaired when he dropped her off at the house and since she was acting intoxicated when the cops got to her she must have been drugged by the LAX team.
There is a couple of small problems though; 1) Driver is not an expert on toxicology, 2) driver can be asked on the stand about what happened to the dancer before he dropped her off (drinking, drugs, sex) and 3) no toxicology or blood sample was taken of the dancer.
I still don't see how the dancer was even raped at the house.

Ah, so would Taylor be the dude she would have called from the bathroom if she did make a call. Was he out though? Did she leave a message? Was that why Kim was waiting in the car? Did Crystal want to try and get him one more time before going with Kim?
What color was the car that dropped Crystal off? Since all were waiting, the Duke boys likely observed and might have even spoken to the driver.

Yeah I would not be surprised if Taylor gave Mangum the beating she was due by the pimp/hooker rules and together they cooked up her not backing out like her past two false claims and seeing if they can get some real money out of this.

That is a good question and one that I have wondered about too. By the time line I put together a while back, the police searched the house on the evennign of 16 March 2006. They had to know she was alledging a crime by then. I wonder if at that point they knew she was alledging rape.
If they knew by the evening of the 16th of March 2006 that she was alledging rape, then that would leave about 42 hour in question. That is we do not know if they came to know this on the 15th or during the day of the 16th of March 2006.

I believe only part of the SANE report was issued to the defense. If the DA is going to come out with NEW evidence, then I'd consider the possibility of it being "tampered" with. The fact that NiFong went personally to pick up the second set of results really, really bothers me because it gives me the impression that he's interferring with "detective" work and possibly chain of custody and that makes things smell "dirty".
SANE in training gets me. It also gives me the impression that someone else was overseeing her AT THE TIME OF THE EXAMINATION.

It is past the date discovery was due. Nifong will have to explain anything new he wants in. So I think any tampered evidence was in the original discovery.
I think before Nifong figure out what he had gotten himself into, he might have tried to tamper with evidence. I think he would not dare risk it now as he knows he might end up in prison. These families are not to be messed with.
SANE in training gets me. It also gives me the impression that someone else was overseeing her AT THE TIME OF THE EXAMINATION.
There was an MD there. But I think the SANE in training [SIT] aids the defense. Consider this cross:
Q: You believe you saw injuries to Mangum's privates?
A: Yes.
Q: You are "in training?"
A: Yes.
Q: How many other alledged rape victims have you examined.
A: She will give some numer maybe zero.
Q: How many women who were not raped have you examined that allows you to compare to someone who was raped with slight to no injuries.
A: She will give some number maybe zero.
Q: Could Ms. Magnum have had swelling and tender breast without being raped.
A: Yes.
Q: So while you said that Ms. Mangum had injuries consistent with rape, you equally could have said Ms. Mangum's condition was consistent with not having been raped?
A: Yes.
Q: Did Ms. Mangum admit to having consensual sex within the prior 72 hours?
A: Yes or no depending on what Mangum said.
Q: Was Ms. Mangum's condition equally consistent with recent consensual sex.
A: Yes.
This could go on and on like this with the SANE becoming bascially a defense witness.

I would assume there is a written report of what Crystal told the SANE (in training) examiner.
It should explicitly say how many men raped her, the type of sex, the location of the alleged rape, the time frame and whether or not they used condoms. Crystal should have also noted that she fell down the stairs.
She said she didn't want to talk to the cop that brought her in anymore. She certainly talked to someone and I'm not sure the defense has all that at this point. This questioning isn't just delegated to detectives. It's what doctors and hospitals do.

Suspension Ends For Duke's Lacrosse Program
June 3, 2006 10:10 a.m. EST
Matthew Smith - All Headline News Contributor
Durham, NC (AHN) - A press conference is expected to be held on Monday to announce the reinstatement of the Duke men's lacrosse program, according to ESPN's George Smith.
Duke spokesperson John Burness denies the report, according to ESPN.com news services.
The program was suspended on March 28 after charges were made against three players for allegedly raping a woman at a team party on March 13.

According to the Duke Administrative Response Report, the three players who resided at 610 N. Buchanan were told of the allegations against the team sometime on March 15. The Duke police notified university officials early the morning of March 15 and they notified the lacrosse coach who then notified the players.

I would assume there is a written report of what Crystal told the SANE (in training) examiner. Wouldn't that say whether or not the A/V was the one who denied to have the tox report done?
