The US Supreme Court on Monday vacated Judge Boasberg’s orders barring the Trump Administration’s removals of Venezuelan gang members under the Alien Enemies Act.

The high court said Boasberg did not have jurisdiction.

I’d suggest disregarding the post at 95 that was a reply to you. It’s ignorant of Ludecke that specifically allows for judicial review of those subject to the AEA. Just embarrassing.

People are getting tied up reading the dissents written by the liberal judges. When it comes down to it, those have no bearing on the majority of the Court’s decision and are not rulings in the case. Just read the first six pages.

I too hate auto-correct. Sometimes it picks the strangest words to insert in place of what you typed.

No. All of the justices agreed that courts have jurisdiction to rule on deportations based on the Alien Enemies Act. This is a reversal of a previous SCOTUS decision saying it was beyond judicial reach. And they agreed that the prospective deported have to be notified in advance and given a chance to refute their membership in a gang. Which probably means that the US has the burden to prove they are lying.

The only thing they disagreed with Boasberg about was that the hearings should be held where the detention is, not in DC.

And they have to be brought in the jurisdiction of the judge ... not just collected and brought before the judge that they just shopped.

Glad this was done as he shouldn’t have ANY Jurisdiction over any executive decision. Let it work through the courts normally like Biden’s loan relief scam did.

That scam was labeled “loan forgiveness”. Some kind of fake compassion for getting someone else to pay off a deadbeat’s democrat voter’s loans.

"The detainees seek equitable relief against the implementation of the Proclamation and against their removal under the AEA. They challenge the Government’s interpretation of the Act and assert that they do not fall within the category of removable alien enemies. But we do not reach those arguments. Challenges to removal under the AEA, a statute which largely “ ‘preclude[s] judicial review,’ ” Ludecke v. Watkins, 335 U. S. 160, 163−164, (1948), must be brought in habeas."

This is the brilliant mind we now have on SCOTUS. I bet she watches The View everything morning. The Constitution of the United State is just a little older than this law.

This country needs divine intervention soon.

That doesn’t seem to agree with what somebody posted from the actual decision. It seems strange that they would slap down Boasberg for ignoring the previous SCOTUS ruling, when their decision is that the deported have to be given a hearing to contest the executive action.

Maybe they’re saying the Pres can decide to deport them without judicial control, but before individuals can be so deported the govt has to prove that they belong to a terrorist gang? But if that’s the case then how can this uphold the previous SCOTUS ruling saying these deportations ate not subject to judicial review? Especially ially if it is a JUDICIAL hearing, not an administrative one?

The reply at 106 to your post is incorrect. That poster simply does not understand the decision in Ludecke which is the Supreme Court case that established that Federal Courts do have the ability for judicial review of those held per the AEA.

Hint - AJ Barrett is not a fan of the shadow docket and is a fan of cases being more fully briefed before they reach the USSC.
